Been refused consent to let by Halifax

  • I am losing track...Just to clarify exactly what happened when I went to the Halifax initially:

    I told them that there was a possibility that I was going to be moving to Aberdeen in the near future and wanted to discuss what I needed to do to get consent to let. I was told by the woman that this would not be possible on my current SV and that if I changed to a 'product' as she called it then I could apply for consent to let.

    I did as she suggested and paid the £1000 fee. She gave me the paperwork to complete getting my consent to let and told me to send it off to the Halifax. I did this in January (after I had moved up) and then about 3 weeks later I got a letter back from the Halifax asking me to make another appointment.
    I just thought it was going to be to finialise the details but it turns out that they had to make a 'business case' for my consent to let.

    At no time did the original lady tell me that there would be a problem with getting consent to let but she did also not explicitly say that it would be granted either. I don't know if this counts as miss-selling or not? Sounds like probably not.

    I had a missed call from the branch about an hour ago - I called back but the lady is now in a meeting - still waiting...

    I wouldn't waste your time going down the mis-selling route as you were told you were applying for consent, rather than being told you would be given consent.

    Simply because "the lady" is not the one who takes the decision..........it is referred to Halifax central underwriting department.........the lady merely process's application ensuring they meet criteria for consideration........She wouldn't be able to submit an application on a SVR...So you agreed to the conditions required for consideration....

    I understand all of that, I was merely clarifying what had happened due to all the speculation.

    Just see what happens when they make their decision, but if they knew you never fitted the criteria at the time why did she say this, im sure there are loads of posts on here going back up to nearly a year saying that the halifax will not give you consent to let unless you have got 25% ltv.

    Anyway it doesnt matter whether you get consent to let or not, its whether you rent it without consent, but thats up to you, and all the sites i have seen it is very very very rare a mortgage company will reposess the house, and the only time this may happen is if you the landlord doesnt pay the mortgage.

    basically the only person who can force this to happen emma is yourself by not s paying the mortgage, even shelter say its very rare a banks will throw out paying tenants, even if the homeowner hasnt got consent, theysay this only usually happens when the houseowner is in arrears and not paying the mortgage.

    Recent article in the FT about this, mentioning Halifax specifically - quite interesting, seems to suggest that there could be a penalty if you let without consent, but doesnt state what that is - presumably financial,
    be interesting to know the details.
