Brand new computer already used-money back?

Hope someone can give us some advice. My husband bought a dell laptop (nearly £4Ks worth) and requested it be sent to his work address.

On the day it was supposed to be delivered no laptop arrived.He phoned Dell who said it had been delivered and signed for. My husband was furious so Dell chased it up and redelivered to our HOME address.
Luckily my 13 year old son had just got home from school so took the delivery of an OPENED box (he phoned his dad who said to accept it).

When my husband and I got home and set up the computer we noticed that under the Dell icon, in the start up menu (where your laptop's name appears) it said 'DELLRIDIOTS'.

Now, obviously, someone has been on the laptop before us and set it up with this name. We have phoned up Dell several times and demanded a replacement (not unreasonable for the price we have paid, we think) but all they want to know is if it is working.

Do you think we are being unreasonable, seeing that it was their mistake that they delivered to the wrong address?

    I think it is more than reasonable to demand a replacement if you have purchased something new that has already been opened. If Dell delivered to the wrong place and someone opened it and used it, it is Dell's problem and not yours.

    If this happened to me I'd be furious, and looking to reject it under the SOGA

    I can only agree with the above. Demand a replacement.

    Also, I find this hilarious

    Apart from the obvious Distance Selling Regs, Dell do/did have a pretty straightforward money back guarantee with their systems. Just return via this, no fight at all.

    Did you buy on finance or with a credit card. If so they are liable too.

    Here's the update:

    The sales rep (from call centre in India) told my husband that he was lying and that he didn't ask for it to be delivered to his work address. Things got heated and the 'conversation' continued on conference call with her supervisor. She wouldn't back down even though we had a confirmation email re delivery!!

    She finally phoned back offering £100 off or send it back and re order ''but please don't tell them why you are returning it.'' ( How stupid will that look?)

    Well, of course, we told them and there was no problem at all!

    Dell CS have fallen through the floor since they upped and left Ireland. Their indian call centre is atrocious, and I'm generally a Dell fan.

    return under distance selling regs.

    were the goods described as new? i doubt it, its often the consumers assumption when buying ie when you buy goods form a shop they could have been returned by another customer previously.
