I emailed them yesterday to ask how the claim is going as the 40 days is up on Tuesday and hours later I got a curt reply stating that the decision maker had asked for a medical to be done and the doctor would be in touch with us shortly and I replied back stating that in my original email I did say that the medical had already taken place and had no reply back to this.

It can take up to 13 weeks for a decision to be made.
It's getting me worried and it's so annoying when you see genuine people get turned down when others you see walking around doing every day stuff etc who are swinging the lead.

You do realise it's possible to get DLA & be perfectly capable of walking?

Where we live there are loads of dead heads not working and people like my hubby who still has a job to go to when he's better getting treat like dirt and this really gets to him and hurts him.

It really makes you wonder if you should be truthful or embelish it a lot more.

When he had his interview with pathways the woman said that genuine people should easy get through and the people with errr pretend back complaints shouldn't but we all know that they say bad back as it's hard to disprove.
How the hell do you know that "Others walking around are swinging the lead?"
What is your problem and how has he been treated like dirt?

Hes had a medical as part of the application and now because you are impatient everyone else is deadwood and a scrounger whilst poor old you and your hubby are hard done by?

You also wonder whether you should "Embellish" you story a bit more? What...just in case???

Its people with this attitude that give the disabled a bad name when it comes to claiming rightful benefits!!

I know people can claim dla if they can walk as I've had it for a number of years.

As we all know that some people do think it is an easy way out of not working and my x is defo one of those people not working for 13 years and saying he has a bad back. The woman at pathways told us that a lot of people use this as an excuse as it's hard to disprove hence why the government are trying to weed the pretenders away from benefit and back into work.

I don't portray to be poor old me, sheesh I only came on here for advice and to be honest, some people seem to swoop down like vultures onto some members who are actually genuine and not coming on here just to troll.

The point I was trying to get across is that people who actually have disabilities are getting pushed into work when they aren't capable when they should be looking at people who have got the capacity to work.

As I've said previously my OH would got back to his job like a shot if he could as he misses it terribly and they are keeping the job open for him but they he's been told about retraining etc and he hasn't even come to terms with a disability and how it actually is going to affect him long term.

I thought a forum was all about been able to put your point of view across or does everyone have to conform to what everyone else thinks.

It's not just hard for the person coming to terms with a disability but also close family as it's usually left up to them to find out information and this is a massive pressure and this is what actually puts people off finding out what they're entitled to or what treatment there are for conditions, well if you don't get friendly answers then this makes you think well if this is what it's like then there's no point in seeking more out.

As for embellish I meant as for a bad day but all days aren't the same, some are good and some may be better then that or very bad, who knows how a days going to be.

  • I reckon when claiming DLA you should state your conditions as if it were your worst day anyway, no embelishment required. If you meant to exaggerate the condition in the hope of strengthening your case then I'd say don't do it. It's not worth the risk.

Doing it on worst day is fraud.

Working has nothing to do with DLA - there are many people who claim DLA and work.

They ask questions to try to establish your cognitive functions and such. My dad was aked how old he was, who was prime minister, how old my mum was and how many children does the Queen have. All a bit random but I guess it lets them work out how in touch with reality someone is.

I would be stuffed! i dont know how old my mum is, no idea who the prime minister is and no idea how many kids the queen has!:rotfl:

What has DLA got to do with going to work?

At the end of the day, if your husband is found fit enough to go to work then he should go to work.
There are not that many people who truly are unable to work at something.
