T&Cs

Options
Ok I've had a few people give me stick for 'not reading the T&Cs'.

What about when they change them but neglect to tell me?

I've recently been stung by Barclaycard for being over my limit on the 1st of the month. I.e they charged me once for being over my limit (fair enough) but then again for being over my limit a couple of weeks later.

I rang up Barclaycard to ask them about this and they said it's always been like that.

So I mentioned the same thing had happened to me back in March but I wasn't charged that time. Oh the computer probably missed it that time but i can assure you it's standard practice.

Well I hung up and decided to check my statements for the past 12 months. Sure enough I'd been the same position before a few times and again wasn't charged for being over my limit on the 1st.

So how can they say it's normal? I've not received any updated T&Cs letters in that whole time.

Is it still my fault if they change their T&Cs and neglect to tell me?

I'm sure i'll get some "yes it's always your fault" replies to this thread.

Anyone else had this from Barclaycard or other CC companies?

They do not need to send you seperate change of T&C letters. Most companies will include a leaflet about 'changes to your card' with your statement.

I've had several in the last few months because of the reductions in charges.

Chances are - they did send it to you - and you threw it away thinking it was junk.

I always read the letters that come with my statement just to be on the safe side. If they have changed the T&Cs then it would have been sometime since March.

Yes most of it is ads for loans and insurance. I did receive one recently after i'd been charged which mentioned the reduction in fees.

It's not uncommon for providers to notify you of 'minor' changes on the statement itself.

For example, Capital One have a box at the left hand side of the statement. Usually this contains an advert of sorts (eg 'why not apply for a loan?' and 'did you know we also do savings accounts?'), but they also used this box to notify my wife of a change to the cash withdrawal fee earlier this year.

If you consistently operate your account so it's over the limit, then you get what you ask for.

For me, another attempt at criticising Barclaycard when it's really your inability to balance your finances that is to blame.

But, I wouldn't expect anything else on MSE. No-one on here is ever to blame.

Can you see if there's anything in there about being charged again if you're over your limit on the 1st of the following month?

I couldn't find it in any of the documentation sent to me by Barclaycard. I'm guessing it's sometime after March when I was over my limit last on the 1st and wasn't charged twice.

Yes which i said I was charged £20 for. Which I agree is fine if a little high.

What I'm not happy with is being charged £20 again on the 1st of the following month because I was still over my limit even though back in March the same situation didn't incur an extra charge. They can't say it's always been that way when that shows it quite clearly hasn't. If i've not been charged before and not received any notification that anything has changed how am I supposed to know?

I've had a look and the answer is no, it states that they have reduced the penalty charges for late payments, and being over the credit limit.

It also states that any promo that you happen to be on if you are late/over limit will result in the full APR being applied.

But could the first occasion not simply be a "period of grace"? A "one off freebie" or a "we've overlooked this first breach and we'll not charge you this time, but we will every other time"? Unlike a CC company to be so understanding, but you never know...
