That's nice and clear and sensible, un-roadworthy vehicles are worth less so we pay out less.
What do you think they'll do if there is no evidence of un-roadworthiness but the car just doesn't have an MOT. Knock the cost of a test off the value?
Cars without a valid MOT are generally settled on the "Trade" value although there can be exceptions
It is fairly rare (Except for Quinn and Tradex) for an Insurer to reject a claim due to the car being unroadworthy. Note the words the Ombudsman uses eg "good evidence" and "The loss or damage was caused (or substantially contributed to)" So an Insurer would have too demonstrate that the fault caused or substantially contributed to the incident.
A few Vauxhalls had an problem with their handbrake failing and often rolling into other property or people. The Ombudsman would normally expect the Insurers to pay these claims as although the part was faulty in these cases it would not be possible for the owner to know that.
In addition if you have ever had a claim you will have found the majority of Insurers use fairly unskilled staff to take details of a claim and for most accidents they would just hand it over to they approved repairer who would then handle the quoting and repairing of the car. The repairers are normally just interested in getting the physical damage to a car and will normally not look for mechanical defects unless instructed by the Insurers. Most Insurers would not request site of an MOT except for written off and / or Fire Damaged and / or Malicious Damage and / or Stolen vehicles

P.S I have never heard of an Insurer deducting the cost of an MOT from an offer for a car without a MOT0 -

If you are stationary in the vehicle you can leave it in neutral, at all other times you should park and leave the vehicle in gear in case of handbrake failure or someone forgetting to put it on as the OP in this thread managed so successfully to do, also if parking on a hill turn your front wheels towards the kerb dependant on which way your vehicle is facing.

Hey, we got 2 towels from a market stall from my inlaws. I think a Micra was a pretty decent present......I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say.0 -

Here is a similar case where the Insurer tried using the general MOT exclusion to not pay a claim, which after the OP sought advice from MSE members was subsequently paid.

Note Quinn lost a famous court case for many many millions of pounds where they tried to bump a customer on a claim and the judge came very close to a contempt of court charge against a senior member of their staff as he kept [STRIKE]telling lies[/STRIKE] changing his story0
