Hello,
Quick question. I received 2 items this morning (2 different sellers) neither of which are as described. How do I go about claiming a refund. I have never done it before as I am fairly new to Ebay so thought I shoudl ask the more experienced ebayers on here so I don't break any rules.
TIA

Will be following this thread!!! I received a ring this morning, that is flawed a heck of a lot more than the seller described!! In fact, he didn't bring the flaw up in his description! Merely used the clarity as a guide.
Anyways, I want to return my item, but his return policy says that he will take about £70 out of the refund. Total cost was £330!! "Never save something for a special occasion. Every day in your life is a special occasion". _party_0 -
Firstly let the seller know you are not happy, give them the opportunity to make a full refund.
If the seller is not co operative and assuming you paid by paypal you can start a claim for item not as described. However this is not a guarantee that you will get your money back as item not as described is subjective and paypal could go either way. For instance something sold as brand new that is obviously used on arrival stands a good chance of being refunded, however something used that has more flaws or more damage than it states in the description is more difficult. The seller may argue that absence of something in the description means the buyer should have asked before bidding.
Assuming that paypal find in favour of the buyer the item must be returned by a trackable method (and insured against loss) and only on receipt will the seller give a refund of the item cost and original p and p but not return p and p.

Keep it very friendly in your opening exchange with the seller. I tend to say something along the lines of:-
"Many thanks for the prompt delivery of XXX, however the item is not working/scratched/damaged. Please advise"
As a seller I respond in a more positive way to an approach like this, if a buyer starts by threatening me then I start to wonder what their game is. It also puts the onus on the seller to come up with a solution. If seller doesn't respond or is unhelpfull you can then escalate your complaint.0 -
yes most important to start off politely otherwise u get nowhere, as others above say it was not as u expected - when u return it make sure it is by a trackable method and tell the seller u are sending by for example recorded then they know that u can check when its delivered and cant say they havent recieved it
when all else fails start paypal dispute:rolleyes: Democracy is a process by which the people are free to choose the man who will get the blame.:j0 -

With this one, I would say his £70 fee is unfair. The item is significantly not as described. I would ask for a full refund upon return of the item (through tracked post, so that you can prove it to Paypal). Open a paypal dispute and go for the full amount. In a rut? Can't get out? Don't know why?

Please don't forget that if you do get a refund and have to therefore return the item make sure it goes special delivery if over £32 in value. If the item gets lost recorded only covers up to £32, so don't risk it.

Hi Mishka
Firstly let me start off by saying that I realise for the money that I paid for the ring I won't get a perfect diamond. I know that the diamond is going to be flawed and that the Clarity (I1, in this case) means that there are flaws but HARD to notice with the naked eye.
However, this diamond has a clear crack running through it, and also if you run your finger along the side of the diamond it feels like there is a 'chip'.
One half of the diamond is perfectly clear and really does sparkle. The other side of the diamond is distinctly 'cracked' (although I am sure that is not the correct terminology). When you look at the picture on ebay you can not visably see the cracks, so I suspect that it is not the EXACT same ring!
It is a STUNNING ring and I burst into tears when I saw it. It was meant to be an engagement ring!!
I just wish that the listing had been more descriptive. ie: Where the seller said I1 (very sparkly), he could have also added 'flaws are visable'! I just think that honesty is the best policy. That way it avoids disappointment.
We have sent an email to the seller, but because it was sent Saturday afternoon, we are not expecting a reply until Monday evening! We took everyones advise and have been really nice about it. I really hope that this goes smoothly as £300 plus, is a lot of money to have to argue over! "Never save something for a special occasion. Any fee for returning an item because it is not as described/damaged etc is illegal. They cannot charge you it full stop. email them, explain the situation and see what the response is. If it's not favourable then put a dispute in.MyUserNamesTaken wrote:With this one, I would say his £70 fee is unfair. The item is significantly not as described. Miss behaving,
My husband just tried to explain it to me but as i just woke him up from a doze he didnt make great sense !! He said that it should have some inclusions and these can minimize the sparkle of a ring. BUT................
I think that, as you said, some jewellers hide behind carat sizes and use the grading scale to confuse buyers, basically hoping they can get away with poor grading diamonds and the buyer wont care.
If i sold a book as having 'slight damage to pages' and in fact every page was ripped then ive been misleading. Its fine to give something a grading but if its at the very bottom of the scale its un reasonable not to point this out, especially as the buyer cant view the ring in person prior to deciding they are happy.
I would see what they say, refuse the restocking fee as thats just greed, how much does it cost to put it back on the shelf and cover ebay fees , if they dont agree do a chargeback with paypal. If you are lucky enough to win, take your ring to a jewellers and with the refund buy a stonking sparkly diamond and have it set in the ring :j the ring of your dreams at the same price :j
let us know what happens
