It's very clear to me that this gentleman is a trader and you have the evidence to support this. Print everything (all his sales, the fact he MOT'd the car, his offer of £1000 etc) and retain it.
Then write by recorded delivery to the trader stating that he is acting in a trade of selling cars supported by the evidence you have and therefore consumer protection applies namely the SOGA.
As such you are rejecting the vehicle as it is not of a suitable quality or as described and give him 7 days to collect and refund the money.
If he doesnt do this then use MCOL to claim for the car value, costs incurred and storage of the car.
You will almost certainly win. If you can prove he previously sold the car as knackered then report him to trading standards, and VOSA for selling dodgy cars with dodgy MOT's.
Also write further to his employers head office and inform them and ensure they know you have also included them in your report to VOSA for dodgy MOT's0 -
I love this thread. After 30 years in the Motor trade, I can't stand dodgy traders who hide behind the "private sale" con.
I hope it all goes well for the Op and the "private seller" gets their just desserts.
