    To be honest it sounds to me like he is trying to scare you off.

    I think the fact he offered you the cash suggests he has something to hide IMHO. Like othere have mentioned I think that as soon as he got letters from small claims he'd more than likely see that you were serious and decide to sort it out. I'd be tempted to send him a letter recorded delivery showing him all the thinks you have as a) it might make him realise that you won;t just go away, and b) if you did try to claim you would need to show that you had made a reasonable effort to sort it out yourself.

    I'd def have a word with Consumer Direct first though and see what they say.

    Time to take on his employers. Under the threat of a VOSA investigation I am sure they will be willing to help you get this sorted, either by helping with the work being done or by putting pressure on their employee. He certainly should not have MOT'd a vehicle he owned, and did he pay the MOT fee?

    Wow. I'm a first time poster, but ive killed time lurking here on and off for a number of years. I just want to thank you all for your responses, all are helpful in one way or another. i really cannot thank you enough.

    Obviously it's only right that after asking for help, that I keep you all updated!

    So, here we go. i got up very early indeed, to try money claim on line out. I found it very easy. The hardest thing was summarising my claim in one thousand odd characters!! I have claimed £2000.00, plus court costs, which were a little more expensive than keith1950 said! £80.00 in total. I had no problems whatsoever entering my card details to 'blow' the £80.00. I'm confident I am in the right. This was a big deal to me. I've been ripped off in the past, but never felt as strongly as this. I have never taken anyone to court before.


    I was off to work at 7.30. but my supervisor allowed me time to make a couple of calls. Firstly I called Trading Standards, via consumer direct. I explained as well as I could verbally, and was given a reference number. The gentleman I spoke to informed me there could be a criminal aspect to this sale, and he was going to email the notes, and my details to the relevent boroughs trading standards. I have been instructed to keep in contact with them throughout. Even if he was considered a private seller, its possible he could have broken the law.

    I have also had a very interesting conversation with the group operations director of the large dealership chain the seller works full time for, a man responsible for some 800 employees. This was a twenty minute call, and the director spoke candidly. Watch this space. I will elaborate further in time on this. All I will say is something is not right here.

    I got home from work, and checked the small claims court website, and the claim has been accepted, meaning the seller will shortly recieve the paperwork.

    Currently, im writing one final well constructed email, setting out all my evidence which will I will send to the seller, by both email and registered post, his employer, and trading standards should the need arise.

  • glad to know youll keep us informed has the sellers local trading standards office contacted you yet for more details. i bet that large dealership the seller works for isnt happy he carried out his own mot at their premises with their equipment. do you have the v5 of the car yet if so who was the previous registered owner perhaps a letter to them would clarify who they sold the vehicle to it may just be that it was that dealership/company! and if this that is the case i'd be querying the dealership of how this vehicle came to be in his possesion as with other vehicles he's attempting to sell!
  • keep us posted. I've been looking for a car for a while and I've seen quite a few adverts pretending they're private sellers when in fact they have many cars for sale at the same time. Should report them really in case they're ripping people off like in the OP's case.

    Keep it low key in case any one from the garage side reads this, especially as you have now a claim in. Update us when it's sorted though.

    Firstly, sorry for your problems, you seem a very geuine sort.

    Secondly, what an intrigueing read and 10/10 for pursuing this, will look forward to the outcome :T :T :T

    But as said above, don't jepardise your case by printing too much info untill you have a result, the tinternet isn't quite as anonimous as some might think ;);)
