  • Hi Orc,

Theres no doubt I've been very gullable. The guy who got me to sign up was my IFA. I received a few letters from CCLS acting on behalf of Cartel but when there was no action I rang the IFA up. I remeber him telling me that there would be big payments in Oct 09' and to wait. After that still no word. When I spoke to him just after xmas he told he had stopped doing it as he was getting too much hassle. At that point he told me to get in touch with Cartel. It was at that point they were imploding along with CCLS and it got to the point where they never even answered the phone.A lawyer friend has told me to go after the IFA acting as the agent and take him to small claims or to see if he has professional indemnity insurance.

    hello there

please have a read through a thread on scam.com, which has plenty of information on what is happening. Here it is for you.

At the moment things don't look good for you I'm afraid.
Please ignore those people who post on this forum who deliberately try to misinform you. Don't be bullied by them, don't be blamed by them. You know who I mean.
You come here for advice, help and support- thats what I and like minded others will try to do.
  • I am a Cartel client who has been offered by my rep, to get cases from Gordons, and pass to grassroots. They will continue claims without up front fees, they will also take any fresh claims which i had not done, and work on them without up front fees, they say all fees deferred to the end and only payable on success. I cant see the risk in doing this as otherwise i have lost my initial cartel fee ( as i paid by cheque) and i also have dead or inactive claims.

If i am not parting with cash, and getting my claims actioned is this not my best option??

    Thanks

The only risk is that you are then accepting them doing business with you and Cartel get off scott free as they have done their bit in getting you a solicitor.

IF you agree to this new company taking on your complaint you will then have to wait another maybe 18 months again to see what happens (if anything!!) with your complaint and by this time Cartel will no doubt go under and you will have no company to complain to and also you will have bob hope of getting your complaint through to FOS (if this is PPI) and again Cartel will just be able to open up another company and screw a few more peeps.

Just my view here but I just see this latest passing claims on as a way of "stalling" complaints against them.

Quote: people need to take some responsibilty....So many who have lost money have just been plain greedy and thot they'd get out of paying....Why are so people so gullible...why should they have debts written off that they have incurred...madness!!

However people just have to wake up to responsibilities and realise nothing is for nothing in this life. It's simple, you borrow money, you pay it back....

I have read through this thread with much intrest and believe me it takes a lot to get me interested in financial site.

As much as I agree with what Vigilant22 has posted I can also see other reasons debt cannot be paid off. Its not right to tar everyone with the same brush as not everyone is so fortunate to have a debt free life. Not everyone tries to weedle out of paying back their responsabilities.

A close friend of mine was talking to me about this company "grass roots" as she has just agreed to let them do a "no win no fee" claim for her and I thought I would check out their profile and see what they were all about.

I for one have very little debt and as such is very manageable. I count myself as lucky not to have needed to rely on huge loans and debt consolidation. However not everyone is in the same boat.

In these financially troubled times when there is no such thing as a secure job, house prices soaring, minimum wage, and streamlining businesses. Its easy to see why people can end up in a financial tornado.

Now returning to my friend...She found herself in a situation that meant she could either lose her job or have a wage cut. She opted for the latter to keep the money coming in as there was a lack of jobs in her field within a commutable distance. Her and her husband tightened their belts and got on with it until something better came along. One of the things they did was to pay the minimum payment on their credit cards. Eighteen months on they had a look at their card balances to see what was outstanding only to discover that their outstanding balance on both cards had increased! The cards had been taken out in 2001 and 2003. Both cards had PPI and both companies were charging intrest on the monthly PPI amount. In both cases the the minimum monthly payment was around £5 less than the interest charged. Needless to say they started to look intothe legal implications this held and of course ended up in the arms of Grass Roots.

I will point her in this direction and see if I can deter her from her current course of action.

Many thanks for the information it has been most useful

    Hello ecoman daz

Please advise your friend not to use grassroots, note the links to Cartel and what happened to clients of them (and other such companies)- read through this thread on scam.com. That gives useful information about the issue. Heres a link for you- its a long read I'm afraid.

My understanding Grassroots and Cartel are one and the same really.

Over on Legal Beagles this matter has been highlighted to the MOJ on our regular bulletins to them on this and many other CMC's who are now towing the line.

Many thanks, we did highlight the fact that there were quite a few company spin offs which we found and fully agree with you that they are trying other routes - excuse the pun (Grassroots) to extort money. One of our members also had a call from Grassroots offering their service - she put the phone down.

I've just put a post over there regarding SMD Exchange Ltd which is Carl Wright's new company. Is there any way to get this new company highlighted to the MOJ before he runs away with more people's money again?

don't know if you anyone can help.
I entered into a contract with Grass roots on a deferred defended claim september 2011.
Their solicitor have just written to me demanding £705 today or they will add interest on etc to the value of £1257.05 if we do not pay today.
The is because they feel they have provided the services defined in their contract.
We still have the credit card outstanding and have had almost 15 different debit collectors..so no they have no fulfilled there contract.
    Not sure where we stand..
It says that the company changed name in 27th November 2012 to Debt and Claims limited and now wish there payment.
I have called the solicitor the durespartnership they say we must pay even though as they have been instructed to get the money..
    Can anyone help..

So I take it that they (or a solicitor, maybe ATM Solicitors?) 'deemed' your credit card contract as unenforceable and they are charging you a percentage of your outstanding balance?

Do you have the ''Provision of Claims Services Agreement (Rescue Clients)'' contract and is it ticked in the ''Instructions To Us'' box as ''Consider to put forwards as a defended claim'' ?
