Dla/lha

i am currently recieving dla for my 5 year old daughter, as she need care during the day and at night, before i was reciving this i was living in a 3 bedroom house, split up with my husband and went on benefits. i had to move out of my 3 bed house to a 2 bed house due to me having 2 children under 10 and they would only pay me for a 2 bed house and the difference was £30 a week, i am just wondering now i recieve dla higher rate care,( award norice sates on it that she need care through out the night, if i would be entitled to a 3 bedroom rate as my 4 year old get disturbed during the night when i am having to attended to my daughter thanks

    Im sure this question was asked previously about an older couple and they needed seperate bedrooms but were only entitled to the 1 bedroom rate.
    Theres nothing stopping you getting a 3 bedroom house at all, you just need to make up the shortfall as they will only give the lha rate for a 2bedroom as thats all your entitled to
  • i know that!!! but due to my daughter disturbing my other child!!

    i have rang HB today to ask them, they have told me that i may request it in right and they will look into it for me. so i said to the man, i don't want to move if i am not going to be able to get it. and if i write before i find a house when i move u may decline it and then make me write another letter!! I am in a catch 2 situation lol x

    they where a couple and i see that a bit different, at the moment i have my daughter in bed with me so she isnt disturbing my other child, she doesnt like sleeping with me, and my bedroom isnt big enough to put her bed in, and i cant swap rooms and room i class as her bedroom as bunkbeds in as it isnt big enough to have 2 single beds and and walk around

    At the moment you are only entitled to a two bed property going by the guidelines set by the LHA website.

  • I have a daughter and two sons. My daughter has her own bedroom and the boys share. My older son has significant needs overnight and this can lead to my younger son waking up. Unfortunately, it is just a fact of life. It does not mean that rules can be altered for you.

    Not really; an elderly person, particularly when also a carer, needs their sleep just as nuch as a child does.

    Could you not put 2 single beds in your room for the 2 children and a single bed in the smaller room for yourself?
  • after going down to the local council this morning and speaking to an advisor and requested it in writing. they have advises me that, it will be looked into and everycase is different they will request reports from doctors etc.. and make a decision and what they say.

    i am not asking for the rules to be changed for me. i have olny recently gone on benefits due to my marriage breakdown!! so was asking for advice as when u ring these places up they all tell u different answers!! if you dont ask you dont get and this is something i have realised since going on benefits, unlike some of you who have prob been on benefits for years!!!

    Some people have good reason to be on benefits for years. They don't all sit at home all day and do sod all.
