Car bought off classified ad on ebay not as discribed

Bought car off ebay and it broke down within one hour.Had to have it towed my break down said head gasket had gone.contacted seller as state in ad the head gasket had been replace and recipt with car said it had beeen replace on 26/02/2010.Tried to get seller to give me full detail of garage where repair had been done as recipt only had name on it not address still waiting for those details.In mean time my local garage has looked at car said head gasket has gone there was no themostat in car and inlet minifold was broke in all it will cost £600 to put right I have now told my garage to do work need as can't wait any longer as need car.seller keeps stating that his discription in his ad was fine.Is there anything I can do have contacted ebay they suggested contacting the police.

    When you buy an item from a classified in ebay its like a classified in the paper. If they are not a business you have no comeback as its sold as seen. Its just the same as buying anything else privately you have no ebay protection.

  • Thank you for help I have phonned up direct gov and they stated I need to send regested letter to him as car not as dsicribed in ad comes under sale of goods act 1979.Give him 7 days to reply and ring them back if he doesn't respond.

    Reading your original post it sounds like a private seller. If so the SOGA does not apply. So is it a business?

    When you spoke to direct GOV did you tell them it was a private sale?

    Private or business, it has to be exactly as described. If the head gasket was described as new, and you have evidence it is not, then you have some recourse I would say.

    Most of that only applies to business's
    If however you buy the car as a private sale from an individual, who doesn’t trade in cars for a living, you won’t benefit from the legal requirement of the seller to provide a car of satisfactory quality. It could be a heap of junk, and you would have no legal recourse.

    Good chance of getting somewhere nowadays. There have been a few good cases where the car wasn't as described.
    Ad said it was a runner, and the head gasket had been done, so it doesn't make much difference if it was a private seller or not, if it's not true, and the professional will put it in writing for a claim.
    Get a print out of the ad.

    No, the first few paragraphs apply to private sales also. It does go on to say "thirdly....." but everything before this applies to the OP I would have thought. Including the line "if certain parts have been replaced, they must not then break down after a short time and so on."
