Cooling off period

Hi all,

When you take out a mobile phone, you usually get a 14 day cooling off period whereby you can return the phone for whatever reason and the contract is cancelled.
Is this the law or just a rule that mobile phone companies choose to adhere by?

Situation is...
Went and bought a mobile phone from a shop/online and when it arrived I discovered I have no signal with that network in my home. I then take the phone back to where I got it within 14 days and I am told they will NOT cancel the contract as they no longer have the 14 day cease period. This is not a franchised dealer - this is a major network.
The 14 day period is no longer part of their terms and conditions of their contract, and I was referred to this and was giving up this 14 day cease time when I signed their contract.

As this is in the terms and conditions, is this still legal? Would it make any difference if I was a business or a consumer?

    Stores no longer offer the 14 day 'cooling off' period for contracts since the handset is demonstrated to you in store.

    The 'distance selling' returns for online purchases is now 7 days.

    Thanks Ann - but what if you are told in store that you get coverage at your home address, then you get home and you dont have coverage?

    That's the situation - was told instore I would get coverage at home, but on getting home I get no signal.

    You have a case buit it's your word against theirs.

    Also no network guarantees coverage inside. If you have 1 bar on your doorstep and it dies when you go in you still are classes as having coverage.
