Faulty goods. & another Pay Pal complaint !!

Hi ,

I really need advice please . My BF bought a laptop for me from e bay . It was described as fully working , but non returnable.
When it arrived their was no operating system , and all the installations that we tried wouldn't work . As BF owns his own pc buisiness , he soon discovered that it was faulty .

He contacted the seller, who refused to refund & basicly blamed Royal Mail, saying that it had worked, etc etc .

A dispute was raised with Pay Pal by us which was then accelerated (I think by the seller ). who said it was working fully when it clearly isn't.

Pay Pal e mailed today & said the decision is in favour of the seller .

We now have a laptop that was " mis sold " as working , and to make matters worse , the seller as " rubbed it in " by posting a negative comment in my bf profile :mad:


Is there anything else we can do please. Im so angry people can get away with this .

    Your bf can get the FB removed as its a false Positive and against ebay rules just contact ebay and they should do it. As long as your BF opened a Significantly not as described dispute I'm surprised he didnt win if the listing said there was an OS and there wasn't thats grounds enough. I would if I was him be appealling the dispute. He could always ring PP to clarify why he lost.

    Were you not asked to return it (at your own cost)? They usually find in favour of the buyer as long as it's returned and there's tracking to confirm this but you say you still have it?

    He offered to return the laptop, but the seller said he would not accept it under his " no return" in the advert .

    When we put in the despute , we only put in a couple of lines to say it was faulty . We have never lodged a dispute , and thought we would be given the chance to explain why at a later date .

    The seller replied almost immediately with a page full of reasons why we thought are wrong , including using " corrupt " disks & in experience at installing an operating system a bit Ironic as bf runs his own buisness repairing them :D

    Can we still return it tracked then ? even if the buyer says we cant .
    It no use us as it is . and if we return will he pay if its tracked . Sorry for all the questions .

    It looks like you were not forceful enough with the dispute, paypal are often not very bright and need things explained to them very carefully. You shoul dhave bene able to respond to the dispute once it was opened to fprcibly put your point of view that the laptop was faulty and not as described.

    One thing though, did it say it had an operating system? Daft I know but a laptop doesn't need a OS to be considered working. That might be how the seller won.

    The laptop didn't have an operating system, but the seller said he had had XP on it before posting , which would be impossible due to the fault. The photo he posted at the point of sale , just showed the bios , although he argued that it was proof that the laptop was working .;)

    Basicly it looks as though the laptop was faulty before he posted it , and he's used Royal Mail as an excuse ..

    We have contacted Pay Pal and sent them a detailed e mail today . Hopefully they will see it from our point of view, otherwise Im not sure what else we can do .

    Ring Paypal and explain that you didn't return the item as the seller stipulated he would not accept it back. If you can appeal to them to reopen the case and explain you will return the item (trackable) immediately, THEY will give the refund from his account.

    Edit - I don't mean to be rude but if your BF has his own PC business, could he not have got you a laptop and avoided all this?

    The problem here though is of course that the oP has already lost an SNAD claim, so it is going to be very difficult to persuade paypal to reopen it as there is no new 'evidence' really.

    If you send something back and paypal have found for the seller then you lose the goods and your money.

    The returns policy though is immaterial and the SNAD claim has no bearing on what a seller says , so I can't see that it is going to make any difference.
