What would we be entitled to?

My OH is really unhappy at work and it is making him physically unwell due to stress. Because of this he is going to leave what benefits would we be entitled to if he left his job, we have 2 children and i don't work. He will be looking and has been looking for other employment so need to know just in case their is a gap between him leaving work and finding a new job. Thanks.

    I know if a single person leaves a job they arent entitled to benefits straight away (think its 12 weeks) as its seen as 'choosing' to be unemployed.

    If it is making him unwell then perhaps he could get his doctor to sign him off work and eventually he could leave on medical grounds, ie returning there would make him ill again.

    ..............or maybe he should see his boss, explain the situation frankly on how he feels and see if the firm can do something about it. Remember, if they don't and he eventually leaves, it could be construed as 'constructive dismissal' and he could go to an Ind. Tribunal. Just leaving is unproductive and will do little for his self-esteem. Fighting your corner is a positive move and if he succeeds will do wonders for him.

    If someone resigns they can be sanctioned for between 2 and 26 weeks. If they can prove "good cause" for leaving they may not be sanctioned at all. If they are sanctioned they an appeal to a tribunal and it may be reduced.

    What i really need to know is would we be able to claim Income Support or would we be expected to live on JSA or similiar?

    Families used to get IS but its change to something else (child tax credit?)

  • He may not be able to get JSA if he has voluntarily left his job.

    If it is making him ill, see if the doctor will sign him off sick and he could look for a new job while he is off. Then he'd only have to work his notice (or not, if the Doc still signs him sick).

    I agree with crossleydd42, talk to his boss, his boss is not a mind reader and he may be able to keep his job as well as his sanity :confused:

    It could possibly be his boss that is making him feel the way he does...
