T Mobile closed account

Hi all,
normally busy on the PPI and bank threads, so this ones new for me, but probably on the same direction.
My son used to have a mobile account with T Mobile, but switched over to Orange, he cancelled his account with them in Feb 2009 after giving them their statutary 1 months notice.
Thinking that was that, thought nothing more of it until Septemner 2009 when he (probably for the first time ever lol:D) noticed on his Bank statements that there was still a direct debit going out for T mobile, and to date about £300 since closing it. He contacted them after I persuaded him to, and ask as to why they were still taking these monies when he had cancelled it.
Their reply is probably typical of a lot of services now and that was that they had no recollection of the so called cancellation.
now to my question, what is the possibilities of my son getting this much missed money back from T mobile, as they are stating that he did,nt cancell and I know for a fact he did because they couldnt match the deal with Orange.
He has written to the FOS (with my assistance) but couldnt help due to it not being their area. so any advice as to who to contact would be appreciated. I thought I was savvy in knowing who to contact, but alas I'm not:(

    This totally sum T-Mobile up. I cancelled my contract on the 21st January, i gave them the 30 day notice. But a bill turned up for the contract which i cancelled.

    I was straight on the phone to them, they're absolutely useless company. They have now issued me with a refund, but before this they still collected the DD, even after i contacted them.

    I swapped to O2 back in September, and i'm so glad i did.

    I wish you luck. I spoke to their retentions department.

    Not sure if it helps, but have you considered checking his call data from back then? Surely a call to tmobile will be logged, if that was the last call made to tmobile and the last call made on that number. it's not unthinkable that you could use that to prove that the contract was cancelled in your eyes.

    It's always good to cancel DD's at your bank when you cancel them, double coverage if you like, but you live and learn

    Most networks will only refund back 3 months (even if you can convince them your in the right). They do this as, they say, you're suppoed to check your statements monthly to catch these things. . .

    I don'tknow,but I'd have thought if he can prove that it's their fault, they don't really have a choice but to give him all the cahs, but as I said, I don't know.
  • Thanks for the advice people, but it is my sons account so will ask if he made call to them via his mobile and to check with T Mobile regarding call log as you say regarding last time of use.
    Will keep you informed.
