are t-mobile right?

I bought a toccolite from tmobile last december with a 3 month contract which is now up. I saw someone on here writing about contacting tmobile to get the code and that he got it pretty quickly.
He said

I then came across an email address for their complaints investigation section and wrote to them. Explaining what had happened, the information I had been given by TMobile customer services, and that only on other information forums was the infomation that I would be charged upto £25 for the unlock code. I also said that it was unfair for non-tmobile callers have to wait for ages on the phone to talk to some one and more importantly for unlocking their phones. But I also made it clear that the handset(ToccoF480) had completed its contract term and did not belong to TMobile anymore.'
Anyway, when i asked for the unlock code I got this reply:
[FONT=Verdana, Arial, Helvetica, sans-serif]I've checked the information for to unlock your phone we provide Subsidy PIN. We give Subsidy PIN for those customers who have active account with us.
As you've mentioned in your email that you're out of contract, I'm afraid to let you know that we'll not able to provide you phone unlocking code.
So
Are tmobile right in saying that now i'm not in contract that they do not have to give me a code?
I have about 80pence left on the phone so I'm not sure if I bought more credit, this would give me any better chance of them giving it to me?
Can anyone advise me if this is right?

take it to local dodgy phone shop they'll do it for like £100

local store or market trader is best bet anyway
I paid TMobile £25 for an unlock code it didn't work - the letter said it might not and eventually they refunded the £25. Cost me £15 at the marketTANSTAAFL !0 -
