Mis-sold Orange contract

Hi everyone, need some help after renewing my mobile phone contract with Orange.

I first took out an 18 month contract with Orange in 2008, through the Carphone Warehouse website. All was fine, got a nice new phone, I was happy.

I got a phone call towards the end of my contract from a woman saying she was from Orange - in hindsight I wonder of she was actually from the Carphone Warehouse and calling on behalf of Orange. I told her that I wanted to renew my contract with Orange, I wanted free web browsing and a Blackberry. She told me that I could take out the 'Panther 300' contract with free web browsing, a Blackberry, free Blackberry e-mail, 400 minutes and 300 texts for around £30 a month. I told her that I didn't think that 300 texts would be enough for me, I thought I used more than that. She had a look at my previous usage and told me that I had been using 'around' 300 texts a month, so I would be OK with 300 texts a month. So I agreed to take out that contract, happy that I was getting a great new phone and paying less than I had been on my previous contract.

Every month since then I have used more than 300 texts. I noticed the first month that I was on the new contract (October 2009) as my bill was more than the £30ish it should have been. I looked at my itemised bill and saw that I had gone over my 300 texts - I had used an extra 119. I didn't think too much of it, I assumed that I'd sent more texts than I normally did. But the same thing happened the next month, and every month until now. The first few months I assumed that I was sending more texts than I had done previously, and hence I was paying more than the standard contract tariff. However, looking back over my itemised bills I realised that I was sending the same amount of texts as I always had, but on my old contract I had enough texts to cover the amount that I was sending, a lot more than the 300 texts I was told would be enough.

So, for 6 months now I have been paying more than the £30 a month I should be paying. All because the woman I spoke to INCORRECTLY advised me that 300 texts a month would cover what I used.

I really believe I have been mis-sold this contract, but I'm really not sure where I stand, and what, if anything, I can get Orange to do to rectify the situation.

Any help and advice would be greatly appreciated!

    Really its upto you to come to realise what your requirements are - they can offer you a different deal but its down to you decide. So I do noi think its mis-sold.

    As a workaround, suggest you phone them and perhaps lodge a complaint - they might give you free texts out of goodwill but more likely offer you some sort of bolt on to get extra texts to meet your needs.

    You need to find out who sold you the contract, there's no point complaining to (say) Orange if you were sold it by CPW.
    Did you get any paperwork ? If not call Orange CS and they should be able to tell you (there's a code on the acc screen that shows where the acc originated).

    Since getting my Blackberry a few months ago I have found that email has pretty much replaced text.

    Text is so "yesterday".

    Actually seems email is so yesterday now according to something I read - people are twitting more now which is aka .... texting.

    with orange you need to make sure that you aren't receiving a receipt for sending texts as they cost 1p per text?
    Its not that we have more patience as we grow older, its just that we're too tired to care about all the pointless drama ;)
