A CCJ is quite rare (I'm told) when you are on a DMP. You would have to do something quite naughty to get one ie; not paying your creditors/missing payments through your DMP.

Thanks all, as i said its would be being saved for Debt nothing else but if we saved that up for a year we could effectivly pay off 2 credit cards. I know payplan arnt happy with you doing this but thats what we want to do. I pray no one takes us to court for a CCJ but if they do we will declare it. Anyway its not going to happen unless he works hard so we will have to wait & see.

    Thanks again x

I've done similar - saved my bonuses from work etc which has enabled me to pay off debts along the way.

I'm surprised at Payplan not being happy about it - after all, you are clearing your debts which is what they are supposed to help you do. CCCS were very helpful when I told them and even sent me template letters and an information pack on how to make F&F.

    Good luck.

  • When you take out a DMP inititally do they want to see bankstatements and wage slips?

Yes, CCCS did initially ask for payslips but not bank statements when I started but haven't requested anything since and I've been on my dmp for 2 years.

Took my word on self employed earnings.
    No bank statements.

if the creditor refuses to accept the lower amount they can go down the CCJ route. one of our creditors insisted they had never had any info from CCCS to advise of the payments so we ended up with a CCJ. not nice to have

As above poster has said, it usually is quite rare for a creditor to issue a CCJ whilst in a dmp as creditors generally know that the courts will see that you are making every effort to pay your debts, and paying all you can afford and not look too kindly on the creditor for wasting their time. Also the courts are likely to fix the payment at what you are currently paying anyway so wasting the creditors time.

I've had no threats of it so far during my time in the dmp.

If you were to stop paying for a while, then there could be a risk of a CCJ.

Sorry to hear about that. I would have thought that if you show the courts what you can afford then they should accept it?

    Sounds really unfair.
