And neither should he! If the road is public then OP is entitled to drive down that road, and if the residents don't like it then tough. It's in the same league as the !!!!!! act of placing road cones on the public highway outside your house to reserve a space. These people need to know that they cannot get away with it.DirectDebacle wrote: »The O.P. is only interested in saving his journey time and not interested in how that impacts on other peoples lives. Quite probably there are many other drivers using this short-cut, not just the O.P.
..and this is wrong because..?
If it's a public road then it's a public road. End of.0 -

Yes, but in the OP..a road that has a home made sign which reads 'private road - no access, residents only'.
..
I have looked on the Ordnance Survey map and the road is marked as a public right of way.
So it appears that the road may not be 'private' after all. However, the OP needs to establish this before taking further action.0 -
all the private roads ive seen have led to estates or cul de sacs, thereby not being a through road of any sort. unless its a council erected sign, id ignore it.
would you put any credibility in a spray painted 'no parking' sign, this is similar.Target Savings by end 2009: 20,000
current savings: 20,500 (target hit yippee!)
Debts: 8000 (student loan so doesnt count)
new target savings by Feb 2010: 30,0000 -
Good lord its Private with Public "right of way" even the OS maps states that, why would "the council" erect a sign for somebody elses private land?
People on here would argue the colour of grass.0 -

The O.P. was advised this almost from the start and is following that advice.Bazza5070
TaThanks for the advice, I will re-consult the OS Map and call the Local council

It may be a public footpath and right of way, but not a public road.
For instance, there are farms around here with public rights of way across the fields - but one has no right whatsoever to ride a horse, a bike, or drive a car across those fields.0 -

Is there an echo?0 -
As epninety stated earlier, consult the council's 'Definitive Map'. It has the word 'definitive' in it's name because it is precisely that. OS maps are good but not always accurate.
Even if there is no 'public' right of way documented, prescriptive rights are aquired when the road had been used unchallenged and not in secret by the general public or specific individuals for 20 years or more.Light blue touchpaper and stand well back !0 -
