Erm a question about house deeds

    Yes our deeds weren't sent recorded delivery either, and the solicitor didn't even seem to care that we haven't received them, just sort of shrugged their shoulders (if you can do that over the phone!) and said that we don't need them anyway!

    deeds are not sent recorded as recorded post is put in the same bags as regular and so can still be lost. It is simply signed for, but as so many clients are not there during the day, sometimes they get sent back to the sender as not collected from the post office.

    recorded is no magic safety net.

    I saw a thread on here about house deeds and it got me thinking lol

    Me and OH bought this house in April 2009, well its mortgaged which of course we are payimg.

    We dont have any deeds to say we own this house or anything?

    Is this right? do we not have the deeds yet because quite simply we don't own it yet (till we've paid the mortgage off?)

    If thats the case who has them? our solicitor?

    how many times do I hear my own clients several years after acting telling me they have no proof of ownership. I sent it to them which they acknowledged.

    when the lawyer registeres your ownership they do two things with their file:

    1. write to you wiht a copy so they can then
    2. close the file as complete

    What the client then chooses to do with their last letter and copy of the registered deed, well....we always say we wills tore the clients deeds, as there are always deeds (I use 'deeds' in a loose sense to mean searches we did, the contract papers (inclusive of NHBC and local authority consents as they can delay or cost on a re-sale) and a copy of the final registered title

    We just sold our house which we bought new in 2007. When we paid our mortgage off we wondered who had the deeds, the building society told us they no longer have deeds as such, its all done electronically with the land registery. Our sale has now gone through without problem so I wouldn't worry.

    wow, how did you get a buyer's lawyer not to accept the three year old planning permissions, the possible section 106 agreement, the NHBC/Zurch warranty, the possible road and drainage adoption agreement......usually that is exactly what selling lawyers cannot get hold of and buyers are screaming for it.

    May be it was a local firm and they had taken the precaution of scanning in the planning permissions, s106 agreements, and soil re-mediation reports etc etc when they last dealt with a property on that site.....?

    P.S. I agree with TimmyT - I wouldn't send stuff recorded delivery because people are often out and then they have the drudgery of going down the the local Royal Mail centre to get the envelope.

    My solicitor wrote to me saying that if I wished to I could collect the file and any other original documents from her office, as they would not post them for security reasons.
    I did that and had to sign for them.
    This is an open forum, anyone can post and I just did !
  • When they say deeds are now obsolete, I still wonder what happened to them...
    For our old house we had all the documents dating back to 1867, lovely hand written certificates on massive waxed paper that I framed and hung up in our front room. Even if there is no legal requirement to have them, I would still have liked to have them, as it can tell you lots of interesting stuff about the history of your house...
    I don't think I can hang on til Friday...
