What now??????

I posted last week regarding a notice period my landlord had said i had to give her, she was saying 2 months where really it was just 1 full rent month.

I spoke to her originally on 2nd March saying that i wanted to give my notice in and thats when she said it was a 2 month notice period, i managed to speak with my new landlord and he was fine with that and has dated the tenency to start on the 22nd April.

So she had a verbal saying that i wanted to give my notice in, ive tried to get hold of her since basically asking her how do i issue the notice to her whether it be by special delievery or collection and she is choosing not to get back to any calls, txt's or emails:mad:. I even went to try and find her house yesterday so i could just pop it through the door.

Ive sent the notice via special delievery now as she wasn't getting back to me, so my worry is now is what if she says that the dates ive put down for my notice isn't the right dates for the period where do i stand with that, she is choosing not to get back to me regardless of what kind of communication im sending her.

Thanx in advance for any answers.

    She doesn't get to decide if the dates are right or not. The law determines whether the dates you gave are correct - are they?

    Im now on a rolling periodic tenency as my fixed term ended in november 2009. Ive dated my notice from the 2nd March when i first managed to contact her and thats when she come up with that i had to give 2 months, ive dated it to 22nd april, as my rent is due to be paid the 23rd March

    so if anything its more than a month's notice she has recieved, i just dont know why she is stating that i have to give 2 months notice, i thought she was the 1 who had to give 2 months if she wanted us out the property

    If you're on a Statutory Periodic Tenancy (and it sounds as though you are) then you are right. You gave notice on 2 March. The notice period runs from 23 March to 22 April.

    I assume you've checked the definition of "rent period" or anything similar in the agreement? The rent period normally co-incides with the date the rent is due, but not always.

    Verbal notice is meanless.
    Post it recorded delivery to the address on your contract.
    Are you in a fixed term AST, or periodic?
    If periodic, do you pay rent weekly, monthly or something else?
    What date each month do you pay your rent?

    All these factors affect the notice period you need to give.

    What date did you post the letter?
    What date did she receive it?
    What date did you put IN the letter to end the tenancy?

    Irrelevant what she thinks/says as long as you have got your dates right. If you have, then you simply move out on the day in question and write asking for your deposit back (It IS in a recognised scheme isn't it?)

    So it's a monthly periodic tenancy and you need to give a month's notice ending on 22nd or 23 of the month.

    To end the tenancy on 22 April the last day for your LL to receive the notice is 22 March. So you are fine.

    oh thats ok then, ive been panicking like god knows what, because of her lack of communication skills, and because she said i had to give her the 2 months notice aswell, so if anything i have actually given her plenty of notice. Its whether she chooses to sign for it though. She is beginning to be a bit difficult since ive told her i was moving out.

    You would pay it to her and then she would have to register it in one of the proper schemes and give you the certificate of registration.

    You can phone up the 3 different schemes to find out where (if) it's registered, without her finding out if you're worried about that.

    Someone else will have the phone numbers maybe? or google 'tenancy deposit schemes'
