are HSBC not paying charges back?

I wrote to the bank asking for a print out of the last 9 years of charges and also enclosed a cheque for a tenner to cover any costs.They wrote back to me with some of the charges that I had to pay, but not all of them, saying that they have torn up my cheque, and if I need any more info on my account charges, to go on line and go through personal internet banking. I tried to do this and found that I need a code number to access my account. To get a code number I had to Phone up a call center. After hanging on the phone for half an hour or so, only to be told that "all our operators are busy. Try later" bearing in mind that the call center is on a premium number, I decided to go to the bank.
I showed the chap behind the counter my letter and explained that I need a code number to access my account on line. He said I need to make an appointment, but he also went on to say that the HSBC are not paying out any refunds on previous bank charges. So I guess he knew what I am trying to do, or is he just trying to fob me off by saying that I will be wasting time persueing this?
Can any one point me in the right direction, is it worth carrying on or will it just get thrown out?:(
Has anyone out there had any recent success with a claim against HSBC?

  • He said that verbally so no that is not correct. All banks have to deal with financial hardship claims

    Are you in financial hardship (in the FSA sense)?

    It depends on what basis you are attempting to reclaim charges
    Q: Does this mean the banks won't be refunding charges?
    A: The ruling means that those customers who have complained that the charges are unfair or penalties at common law will not be receiving a refund of charges

    Although the legal opinion is not shared by the banks (and so far the courts). ;)

    Which one? I was commenting on HSBC's opinion which is shared by the banks, lol. The courts have stated that they do not believe a collective challenge on the level of charges can go forwards but they were very specific that fairness may still be challenged....The Supreme Case judgement is fascinating reading :D

  • Thanks for your comments so far,but I am still none the wiser. I would say that I was, and still am in financial hardship as I only have a part time job on a low wage. If I were to get back some of the charges it would help quite a bit. Can any one point me in the right direction, or should I just roll over and forget it.

    I would say that I was, and still am in financial hardship as I only have a part time job on a low wage.

    Financial hardship has a fairly set criteria. Are you in arrears on things like council tax, utilities etc?

    Perhaps not, but that is what the bank in question believes ... and so it would be reasonable, would it not, to think that represents the stance the individual bank will take to such claims?

    We've done this argument before haven't we? We both read the Supreme Court Judgement didn't we? Their judgement does not necessarily support the same interpretation does it? The issue on charges being unfair is not correct but the penalty argument most definitely is out of the equation. Their argument is half right and half wrong.
