    We've done this argument before haven't we? We both read the Supreme Court Judgement didn't we? Their judgement does not necessarily support the same interpretation does it? The issue on charges being unfair is not correct but the penalty argument most definitely is out of the equation. Their argument is half right and half wrong.
    Whatever the actual rights or wrongs of the argument (as you said that has been discussed elsewhere), the link I posted represents the beliefs of the bank in question and so I think it would be reasonable to expect that they will act in accordance with those beliefs, right or wrong, unless forced to do otherwise.

    That may be the case but surely you might want to point to the OP that (a) Penalties at common law are out, but (b) fairness of the charges are still in dispute pointing to the link to the MSE Guide(you are better at linking that I am). Yet you said you need to find another argument when in fact the OP can dispute the interpretation of "fairness" based on MSE template....can we at least agree on that part perhaps?

    I thought I was directly addressing the question posed by the OP by pointing out the interpretation their bank has on matters ... and did go on to say
