Buyer won't honour the sale

I bought an item on Ebay this week. I paid within the hour via Paypal.

There was only one other bidder and the item went to me the second and only other bidder.

The seller emails me two days later and this is what he says

sorry my computer has broke using a friends didnt know it was gone address is 268 ca****** road etc

Next email say

"hi sorry just checked the item something has gone wrong in this listing as it was supposed to be buy it now £30 as i couldnt possibly let it go for winning bid as it was bought for my dad in oct just before he passed away at over £90 hope you understand"

I wrote back and said that I bid, i won, I paid and I would collect the item to fulfill the contract

His next email says

"i appreciate what you have said as i already said my computer has broken and i have to go to a friends to check emails i dont know what has happened as i did put a buy it now for £30 i will of course refund your money and can only apoligise i am a genuine person and would not lie to anyone i will not be selling this for £1.50 as explained it was my late dads and never been used your welcome to take it up with ebay please send me details so i can refund you thanks"

Now he has refunded me

I have left him negative feedback. I have been on Ebay since 2000 and this is the first time I have had to do this

What can I do next because I am furious about this?

    That is so unfair because we had a contract and he broke it - how can he get away with it - surely that is against the principles of Ebay?

    Can't you report them as a non-performing seller?

    He can do it but you just get a refund, neg him and leave him no stars with a plain comment explaining what he did.

    There is nothing you can do other than leave negative feedback and report him as a non performing seller.

    It sucks but that's just the way it is.

    I have to admit playing the "dead card" really did annoy me it is just a form of emotional arm twisting and cuts no ice with me.

    No amount of rules or principles can make someone sell you something they don't want to.

    They were quite honest in their explanation, they could have said they sent it and it was lost in the post, or it got stolen or the cat ate it or whatever.

  • It was a "buyer collects only" item. So given that he was lucky to get any bids locally he should have been honourable and seen the deal through.
