i have now had the following reply

am not a person to complain i had no problem paying the money for the phone but i am not happy with it. It is not working as it should and if u are refusing to refund my money i have no alternative but to report this to ebay.

so i said that it seems to me like you have changed your mind and then i got this

have not changed my mind and i am not lying, i would not say the phone was not working if it was. i am not prepared to keep sending u emails i am now going to contact ebay and tell them u are refusing to refund my money and that the item is faulty.

so i have asked her to explain why she first of all said the camera is fuzzy and has now said that its not working. So i think she is going to report it to ebay but i dont really know what to do now?

Call her bluff. ask to return the phone to you recorded and that you will determine if there is a fault with it. If there is, then refund all + costs. If not, send it back to her. Do you still have the phone numbers etc? Also, if you do get it back, check with you selling photos that it is the same one.

Could always pull another one and say you are phoning the phone company with the imei (i think) and say it stolen and that you want it returned so you can refund the money. This may just keep them quiet if they have tried to switch the phone with their own dodgy one.

How legal all this is I don't know, but hey This is only my opinion and what I would do!

i dont think she will be able to swap it because the housing has anycall on it, i had to have this imported from japan and it took me about 3-4 days to find somewhere that supplied it, it does say anycall on the front so i dont think that she would be able to change the housing.

How hard would it be to put the housing from your sold phone onto another phone of the same make and model? Very easy I suspect. I'm not trying to say that they are doing it but you never know.

If you are confident that the item is as described then dont refund. It sounds like it is.

The buyer admited that the camera was working but fuzzy now it doesnt strange I think. A faulty item does warrent a refund but it worked when she got it. cameras on phones are pants anyway I dont normally use mine its waste of time. OK the newer sony ones arnt too bad.
The auction also states that the front has been replaced with the anycall facia so she cant use that in her complaint either.
The phone not connecting to her pc, it is impossible to say why it doesntI used ot use the older data cables for nokia phones and they were a pain to use but now with USB as long as you have the correct software then it is a doddle Im not a sammy phone user Im a nokia or SPV M series person and I have played with motorolla all the software is pants it sound like the buyer doesnt have a clue or is doing somthing wrong.

A 0 feedback buyer as well you were good to give her a try and she is the reason why peopple dont sell to 0 feedbak ebayers.

If you had 100% feedback I would cave in and give her a refund less costs to procect the feedback but you dont really have much to loose as you have had a few -ve's. Paypal and ebay are a bit hit and miss when it comes to disputes but I expect that you should win.

    Good luck

this is the latest i have had

"as i said before the camera is not work correctly, it is very fuzzy, it cannot focus properly when taking a picture and paying £150 for this phone the camera should be in full working order and i do not except ur explanation that is how the camera works."

i have since sent her pictures that i have taken with the camera, but i had it on 216*240 settings, i have asked her to increase it to the maximum size to see if this makes it better for her?

Oh I think there're having you on. Leave it, write an email stating the phone was in perfect working order and thats what she bought. It's time to draw a close to this dispute. If they leave you negative feedback, so what? is it going to stop anyone else from buying from you? certainly not me for example. I always look at feedback and at both sides of negative feedback. One negative does not put many people off.
Basically, assuming you know yourself that the item was in the order that you stated on ebay when you sent it then, you covered morally.

goodluck and please let us know what the end result is,
