New dog - poorly & prev owners knew -what are my rights?

    just to let you know, i have put in an e-mail to the RSPCA, using their online service and selected the "animal welfare/cruelty" option, which are the emails they say they respond to asap. if i have not heard tomorrow afternoon, i will call the cruelty line again.
    I agree the previous owners behavious seems to be breaking the animal welfare act, and whether or not i get any money back is nothing compared to knowing that they will not be allowed to keep/sell animals again....lets hope I get a better response from RSPCA This time...

    Not wishing to sound harsh but why would the Cruelty Line be interested? The dog is in your care.

    I'm sure that line is for reporting the people who are being cruel to animals and require an immediate response.

    With respect, your issue is in respect of a claim for money.

    They would be interested because it's not just bexy's dog, these people breed them, and if they are willing to keep one in such poor care for two years (presuming they had it from a pup), it's highly likely they will do the same to the other animals in their care.

    Feeding adult dogs puppy food is a no-no, they clearly have no idea how to correctly look after animals to maintain their health. They knew this dog was poorly and opted not to treat it, now possibly leaving it blind or partially sighted - not even to mention the pain it must have felt. Who knows what the conditions are like of their other animals or how many others are suffering in their negligent care?
  • You are very wrong. the cruelty line is there to report just that, cruelty. If the OP can evidence that she received a dog that clearly had illnesses that had been neglected and being fed on a puppy diet, that my friend is cruelty. Puppy food is just that, for puppies that need differnt amounts of minerals, calories and portions.


    The OP has a duty to any remaining animals in the care of the breeders, to report her findings to the RSPCA. It is then the job of the RSPCA to evaluate the situation professionally and IF they deem the breeder to be acting within the law, then at least the OP can walk away happy.


    Furthermore, if a complaint is made then it will be logged and should a situation like this occur again, which it is quite likely that it will, then there is a history for the RSPCA to use.

    COMPLETELY DISREGARDING THE MONEY SIDE OF THIS -

    Were you given Kennel Club Registration papers with this dog? If so, report the breeders to the Kennel Club. I would suspect that will give them a whole heap of trouble! Its also been known for people to say they are Kennel Club registered, but in fact they are not at all, and any papers could even be fraudulent.

    I used to breed/show persian !!!!! cats as my passion in life, but I was and still am registered with the GCCF, and god forbid if I ever tried to disobey their rules.

  • equaliser123: as someone mentioned there are other dogs being bred there, my dog was clearly not looked after properly and yes if i can stop them selling on more poorly dogs and stop more dogs suffering then i will try. Obviously RSPCA might not be interested, but for the sake of a few minutes it is worth my time.
    Muskoka, yes i was given all his papers and have contacted kennel club, they told me to go to consumer direct about my rights etc and didn't act upon my concerns that there are dogs (of a different breed) being bred there.

    I have checked all his papers and sent them off to register him in our name.

    One question (and it is a legit question not baiting): if the dog was in such bad condition and from such a bad home, why did you buy it??

    I thought with these sort of things, you looked at where the mutt came from, saw its parents and stuff like that...?

    Anyway, the contractual / SOGA position has been well reasoned on the Consumer Rights section now. May be time to open a new thread on a different thread.

    From what I have read on previous posts here, the previous owners told bexy that it was a wart, I think, and Bexy bought the dog at the age of 2 yrs, normally you see the parents if they are pups, unless they have been kept as a pet alongside the parents, She was given Kennel club papers, so something is gonna hit the fan when the Kennel club hears about the way in which he was sold on with false medical info.

    That is just an opinion you have Equalizer. I am not saying there arent some unhelpful people in the RSPCA as there are, just like all organisations, but this is something as a whole they would want to know about!!

    Kennel Club could exclude them as a member and I thinks its a shame they are not interested

    In regards to them hearing much more urgent cases.. thats hardly relevant. thats like telling poeple not to bother being mugged for their purse as the police are far busier dealing with murders every day!!

    Whilst not entirely sure about what would happen, I do know that the kennel club is held in high stance, if they are listed as a breeder then they would obviously be removed, dis associated and possibly the Kennel Club would look into it further to make sure that they are not allowed to breed any pedigree for that matter, I have only had dealings with the Pug side of the Kennel club and from what I have seen they are very strict and morals run high, word of mouth amongst the breeders would probably be enough to see these scoundrels running for the hills.
