Looking at your CCA on the link above and it looks as though your agreement is with Halifax. What stage are you at because I'm about to start this week with them.

hi yoda there not to bad but i have to be honest i've not gone too far yet they sent the cca with no problems it was actually with a collection agency iQor Recovery Services, and they sent the details onto Halifax, and they sent the cca but after that i've not really received any mail from them at all it's just gone quiet. a few token payments but thats it. i gotta say Halifax i was expecting to be worse as in general there the worst bank i've ever been with lol but im sure they will get worse if i take it further lol from what i've seen barclays tend to be worse but thats just looking over all the posts.0 -

well it had the signiture but nothing else no payment terms ect so according to here it dosent have the prescribed terms, so i would assume not but its taking that next step i just want to be sure.
What do you mean by few token payments???
I explained i have money problems as i was selfemployed and the company was hitting bad times, it now has been closed as it did go under in december, but the token payments were when they contacted me i offered them £5 and stated i couldn't pay anymore, and then it would just contact me again a few months later and i just did the same.

have you sent your cca to halifax or are you doing it next week i have sent mine today after one year of waking up in the middle of the night worring how the hell i am going to pay them its gotta stop would love to hear from you to if thats ok after reading what nid has said and done it has now gave me the confidence to fight back as they have keep changing agreements i have made with hope you have a great out come my fingers are crossed for you xalways smile no matter how broken you are.0 -

I have a cc with Halifax and it is 110% unenforceable, I have a letter from them saying they are trying to locate it and until they do they would not be pursuing the debt. However if they do find the cca they will enforce the debt. See some of my older posts I think it was on http://forums.moneysavingexpert.com/showthread.html?t=2060575 somewhere on there. I'm sending mine on Monday. I took the agreement out in September 2006. Fingers crossed my agreement is unenforceable. After reading this thread and realizing others are in the same boat it does give you the confidence. I'm in the process of sorting my finances out as I have twins on the way in August. I came across this site and then this thread. What great luck.....
