    got back other 3 letters from solicitor this morning quote.. While it is the case that the bank had not produced your original agreement the test case ruling have stated that we would not be able to bring an action against the bank on this basis... all 3 letters the same. one bank has said quote..we have complied with the reqirements of section 78 of the cc act in particular we have supplied copies compliant with regulations 3(2)(b) of the consumer credit (cancellation notice & copies of documents) regulations 1983
    with regards to your requests concerning closing the account and refunding charges please be aware that the effect of unenforceability under the cca , and such unenforceability does not apply in this case, is to prevent a lender from enforcing the credit agreement in court. end quote
    any advice please. do i send cca dispute/s10 cease & desist?

    Mate I really cannot advise based on what you've said - I thought I said before that you ought to start sending the CCA's again, start from scratch and do it on here? Without sounding smart, i'd not trust any CMC and therefore will not advise on anything they have told you to date cos chances are, its a load of old bollox!

    Start again, its worth it for a fiver......:D

    Good Evening Niddy and the gang

    just popped in to say hiya and hope you are all well, ive been working and sending out my appropiate letters these past few days so dont worry niddy really taking your advice and following it:j

    just so that i dont miss anything ive done myself a little chart of when i last logged in and viewed the last post number then when i pop in again i go back to that number and read forward cos its proving easier to keep up with everyone and the info im learning along the way:beer: just thought id pass that little bit of nugget to all cos if you are like me i was getting lost with all the info and i really dont know how you cope with all of us firing questions and sending you pm's all the time niddy but you are really fab.:T

    Reflecting on my own positition today ive come a long way but its nearly 3 years of worrying about my debts and getting out of mortgage arrears etc and other priorty debts that thankfully resolved but now attacking the non priorty ones and i have to say this thread really has given me huge hope that i can follow from the start to the finish of the appropiate steps -

    id tried other forums in the early days and other charity advice sites but i have to say i really believe i can get results with what ive learnt from this helfpul thread

    (whilst im still hanging in with the cag crowd where i became hopeful from last year that i could get to know and improve on my legal knowledge, well one has to hope from an O Level Law there is always something more to learn ) LMBO

    so for anyone just looking in now keep the faith, and take a leap of faith but above all ultimate decisions you take must be for your own family and your position best needs, and i just wish id found it only earlier but hey everything happens for a reason so i guess im ready to tackle everything now :D

    If you go to your control panel, (User CP up there^^) then it will show your subscribed threads (i.e any you've posted in) and if you click in the little blue arrow to the left of the thread title it'll automatically go to the first unread post.

  • Thanks for the read (over all the posts) any help appreciated.

    I requested my CCA over a year ago (15 feb 2009) and back then i thought you just needed the signature included noting else which it included, but a freind pointed me in this direction i had noticed back then(check my previous posts in my profile) regarding to it missing the repayment plan but with no advice i was worried to carry one

    a copy of what the cca is in the link below with the details of employment ect blanked.
