We also sent the same letter to the halifax and haven't heard nothing. do we send the debtors final response letter and leave it at that?

    Hiya

    Not yet - you ignore both and wait and see what they send back. The final response is only sent when the lender/dca send you a final response. At the moment, they are in default and the accounts are and remain unenforceable until such time they do respond. So you just sit and wait. :D

    NID...hoping u remember my CAPONE business...I hadn't received anymore correspondence so I sent tht standard letter u suggested...they have now bothered to reply...sending yet again a copy of the currnet terms and conditions.

    and the following is quoted from there letter.

    As we have complied with our obligations under S78, we will not be entering into any further correspondence regarding the provision of copy agreements. Your agreement is enforceable and we will conitnue to treat it as such.

    We will continue to pursue the outstanding debt and do not consider this account to be in dispute, therefore would remind you that you are bound by the terms and conditions of your credit agreement and are obliged to maintain payments and repay your outstanding balance.
