    First response received back.
    From the BOS thanking me for the letter and stating they are awaiting the documentation to fulfil my request. Then warning me about the dangers of using claims management companies quoting Bridgit Prentice :rotfl:

    Let me know when they actually respond in kind. I am lost as to why they'd quote a Labour MP!! Although me thinks it is more to do with her role in MoJ ;)

    Sorry, I should have been more clear. I suffer from anxiety and depression and I'm apprehensive about the phone calls and letters from my creditors. I've recently joined and have started the process with the help of your templates and excellent letters. I suppose I'm just looking for a bit of re-assurance that I have your support.

    I've sent the Cease and Desist letter previously so I'll go with the final response letter this time.:)

    2nd response rec'd

    Had a reply from DCA re Citi stating they are awaiting a copy of the original agreement from the original letter.
    If we are unable to forward a copy of the original agreement, we will be able to supply a true copy of the document which will comply with section 77-79 of the consumer credit act 1974.
    We would like to draw your attention to the ruling in the case of McGuffick V RBS 6/10/09 in relation to "what is considered enforcement" etc etc basically stating that demending payment is a step taken prior to the commencement of proceedings and therefore is not considered enforcement. We will continue to report to credit ref agencies.


    Basically they are saying they will continue to chase for payment.

    Sorry should have been clearer, they are quoting her statement as MOJ warning about businesses that mislead the public about debts being written off :)

    Please don't copy my own templates back into the thread - in future just say you sent the *Name of Template*.... so in this case you should have said I sent the CCA Request and they replied with XXX.... Make sense? :beer:

    They are incorrect, send this back to Apex, with the original request and cheque/PO that they returned to you: Follow-Up to DCA - who decline your CCA Request

    Read the letter and you'll see why they have to deal with it. :D
