Does anyone know if the same rules regarding unenforceability apply in Scotland? Also if I go ahead with CCA requests will it hinder my current DMP at all? Thanks. :)

Yes the same rules apply and yes it will affect your DMP because the DMP company cannot set preference to creditors and the fact you'll have to stop paying certain ones will mean a preference to another so you'll need to read a lot more of this thread to learn the pro's and con's before jumping in.

Suffice to say, sod the DMP - there are loads of DMP firms out there, when the creditors fail to respond (which they will, trust me) you'll then stop paying and you may as well then dump the DMP totally. If and when everything is sorted whatever debts are left, you add to a new DMP with a new company. :D

Then got a letter from them yesterday saying they had my credit agreement enclosed and to me it looks pretty enforceable I just wanted to get you to have a look over it, I've got it with me at work today so will try and scan it in at lunch, the default for this dropped off my credit report at the end of April so was just wondering what sort of position I'm in do you think their next step will be to apply a CCJ?

Well I guess you need to look at the agreement before answering any of my questions so will get onto scanning that in!

    Thanks

    Hiya

Yea scan and email it to me please (do you have my email? if not then PM me and i'll supply it). Then we'll see if it is yours or a cheap reconstituted version... does it look real to you, i.e. your signature, your handwriting etc etc? :o

    Hi Niddy,

    Sorry me again! :D

I've been slack :o and I am going to send off the SAR request to 1st Credit (Re Aqua)

Do I offer a repayment plan yet? Or do I hold fire until the SAR info comes back? :o

    Thanks

    Hiya

What is the SAR for? Is this something i'm helping with or 10past6? Sorry, am confused cos I do not suggest sending SAR unless things are proceeding through the courts in which case 10past6 would be helping, not me?

Please clarify and point me to our last convo (linky please) cos right now i'm totally lost! Either way do not make any offer as yet, not until i'm upto speed. Sorry but too busy to go post searching thus i'm asking you to provide a link to the last conversation.... Cheers :D

    Yes do that.

Regards to the call, don't worry too much about their breach of DPA - just make a record of the time and date so you can have them for it later if required, but in the meantime ignore their plea to go to PayPlan and instead send the template you rightly selected. :D

    Afternoon NID.

I sent a CCA request to Barclaycard for an old Skycard and they've just sent back terms & conditions again.

What should I be sending them in return?

Have you ever sent the CCA Query - Terms & Conditions Supplied? If not send that. If you've already sent it, then send this: Debtors Final Response - No CCA Received

    Sorted :D

    Niddy.

It's me again (Sorry) I've got a letter from Mercers now issuing a Default for my Barclaycard!!

I've emailed you a copy of the letter….Do I still send the other letter you advised?

    Thank You!!!

    Hiya

Sorry what other letter? You need to remember since we last spoke i've probs seen 100's of other agreements and spoken to 100's of other people and you really need to start sending me links... As for the email, i'll check later once you confirm exactly what is happening cos i'm confused, is this in relation to the SAR thing you mention earlier or separate?

Sorry - not nagging but you do have to remember I see too much and need reminding by a little update or a link to the last chat!

    Thanks :o

I will be sending the second letter in the cycle this weekend.
