OK so where do I go from here then if it is enforceable. This is the only one showing up on my credit file and it defaulted in May 2005. I had been paying £1 a month but ceased that recently.

Well in that case I don't have much of a choice, I don't have the money to be able to repay it, so what's the blag it route and what are the possible outcomes.RainbowLiberty0 -

Send this - CCA Query
The outcome will be they hassle you for a bit. If they feel they have a good enough case they will threaten legal action at which point the worse they can do is obtain a CCJ, we'd stop that happening and then come to some arrangement - but due to the default date all we gotta do is keep them sweet for a few years, obviously not contacting them at all is the key after sending the above letter. Barclays are not reknown for issuing court proceedings for such small amounts, anyway you would also reclaim all PPi as linked to the loan and this would be refunded to the overall amount, prior to any formal repayment schedule....

Does anyone know if the same rules regarding unenforceability apply in Scotland? Also if I go ahead with CCA requests will it hinder my current DMP at all? Thanks.0

Hi NID a while ago I posted about my debt that is with Lowell Financial, I posted off that letter before waiting for your response? (I dont know if you remember I was suitably scared but you made me feel better in the end sorry I know you must have loads of people you're helping at mo!!)
I had a reponse from them a couple of weeks ago saying that it was too long ago since the agreement was taken out they couldnt get the original credit agreement from Sainsburys so were closing the file and wouldnt contact me again.
So I thought that was all fine was quite happy with that!
Then got a letter from them yesterday saying they had my credit agreement enclosed and to me it looks pretty enforceable I just wanted to get you to have a look over it, I've got it with me at work today so will try and scan it in at lunch, the default for this dropped off my credit report at the end of April so was just wondering what sort of position I'm in do you think their next step will be to apply a CCJ?
Well I guess you need to look at the agreement before answering any of my questions so will get onto scanning that in!
