i have had a reply back from moorcroft about the letter sent in #1099 to argos
it says....
i write in responce to your recent communication in relation to the above account and can confirm we have been n contact with argos ltd who advised us that the default notice was issued in the 26/01/10 for 115.95 however, this was not paid and the account defaulted on the 24/02/10. the outstanding balance of 1890.00 is correct and is due for payment.
i can also confirm i have placed the account on hold and request you to make immediate contact with our call center to discuss a repayment proposal.
i have letters here and no letter states to pay by a certain date
letter sent on 4/01/10 saying arrears 58.05 your account has been stopped to prevent further use and must make immediate payment of 58.05 ( 1 month) if you don't take this opportunity to clear the arrears a default notice will be served on you.
then on 15/01/10 i had my statement through stating i have missed 2 payments please pay 115.95 (i paid 70.00 on 25/01/10 and then i paid 80.00 on 23/02/10 )hope this makes sense so i had 115.95 + 59.60 =175.55. but i paid 70.00 + 80.00=150.00 so iam i right in saying my default was for 25.55 and should i respond to this or leave it and cca them instead

I'll sort this tomorrow for you, i'm slightly confused so will have to search back through your posts to find the links - what, exactly, is happening? Is this an account you are paying off, but they have incorrectly defaulted you with? Please summarise if you get time! Makes my life easier.:D

Regards to your figures above, if the lender issues a pre default notice saying pay £XX then you MUST pay it or they will default you, you cannot just pay £70 and think, oh - they'll be fine with that - you needed authority that they were happy to accept £70 only. Therefore, the DN that was served to you for the £115.95 had to be paid by the date declared (usually 14 days) - otherwise they would default you, as the DCA correctly state - it was not paid and so they defaulted you.
Your amounts don't add up, you had to clear the £115.95 before 2 weeks - you only paid £70 then a further £80 a month later - this was not agreed and so really, you're fighting a losing battle.... you should be ringing and speaking to argos to be fair, ONLY they can help......2010 - year of the troll

If they send an app form you simply respond with the relevant template from page 1 (CCA Query ) - let them make threats, so what - they cannot do anything!!

Just replied to you, via email. You need to check the original they sent you cos the page you just emailed me clearly shows the original reverse, i.e. "for your signature" - does that match page 1 that you sent in the past?
I'll be back later/tomorrow (using iPhone)....
Regardless of the answer, just send what I advised previously, either way it doesn't change anything.....;)
