they should cease interest at default stage yes, but they may add additional charges - unlawfully, but they do it!!

Morning Niddy, I am sending my final responce this morning. it is a 119 days since I requested my CCA from CrapQuest. The last I heard from them was the beginning of April saying that the account was being Handled by a Quality Insurance Officer?

Nooo - you send this if they have not replied to the CCA -

4. CCA Dispute / s.10 Cease & Desist
This is the letter you send if the CCA has not arrived, usually 30 days after the CCA Reminder letter was sent - also a s.10 Cease & Desist letter (s.10 / DPA1998).

Got letter from Apex today about Barclaycard CC, take it I send Account sold while in Dispute letter? Sent out Final Response to them on 10 April. Cheers

hiya wow that has helped me too,as im also in the same position that robinson way/barclaycard - still waiting for their client to provide the cca,

Niddy - Fab news thanksalot!

I know this one is only £600 but tis only the tip of the iceburg of our £70,000 debt (EEEEK!)

The fact that I know that this one is unenforceable just gives me a massive amount of hope for the other ones. We still havent heard from our marbles ones and there are two of them which add up to £22,000 between them. Keeping my fingers firmly crossed with those ones!!!

Cap one have told us that they wont enter into any further correspondance with us - and we have also sent them final response twice on your advice.....So you say to send them CCA Query....after all the letters already sent at this stage is this still okay??
