Its their standard reply - there will be NO such CCJ forthcoming - noooo chance of that, cos you're awaiting the CCA - basically just wait for a response, they have told you they will take no action pending receipt, from the OC. :D:D

    Hi everyone

Sorry not been around for a few days but BF been getting really jealous of the amount of time I'd been spending on the Forums, especially chatting to NIDDY. I keep telling BF exactly where we are up to and the fact I don't even know if Niddy is male/female/hermaphrodite but think he's having an insecurity fit. lol.

I started to trawl everything on my laptop whilst away on holiday (think that annoyed him too -whoops) and then my 28month old daughter fell ontop of my laptop and has bent it slightly, but even worse I've now got awful virus on it that I can't remove, so Im back to the home computer but the internet has been down. Typical.

Anyway back to the debts, doesn't it always come back to that.

Egg, the only one who responded to my CCA request and I last week sent the final letter template too have sold the debt on to a company called Aktiv Kaptial Asset Investment Ltd - I just wanted to double check, as I actually think I might just be about getting the hang of this, but isn't that illegal - that's another template letter of NIDDY's isn't it about selling the debt whilst in dispute. I assume that also means they can't sell the debt after I have written to them the don't contact me again letter as per Niddy's instructions.

    Thanks everyone.

Hiya - send this to Aktiv: Account sold whilst in Default of CCA Request

Regards to the legality, well they all do it - worry not! Also, send a copy of your last reply to Egg, i.e. the Final Response.....

As for the boyfriend, tell him it's fine and this is going to benefit you all (long term) - let him see the posts if it eases his mind, not like we spend all night chatting! You've nothing to hide!

I am a bloke, but only an online person - nobody knows anything about me! I could be a 70 year old wrinkly for all he knows so tell him to behave and have a drink :rotfl:

As for the virus, what is it called? May be worth PMing Proliant (just say NiD sent you to him) - he is awesome with pooters and may be able to offer some assistance.... As for working on holiday - we agreed you'd leave the laptop at home? Nothing was ever that important that it had to ruin your trip :naughty:

    Hi Carol

Yep - The wife (Username = Mrs Niddy) has joined (maybe she felt like an MSE widow?).... she's keeping occupied over on MouseAnn's thread, being the two threads are pretty much interlinked in such a way!

MouseAnn's thread is here - in case anyone wanted to see it: Frightened about my future

Hi again could you also take a look at this one Aqua credit card taken out 2005 being chased by Albion

    Many thanks again !

    Hiya

This is fine, other than the fact it isn't Lender signed and doesn't directly link to the separate terms, it looks good - however i'd be sending this - CCA Query :D

See what they come back with, bear in mind you may well need to arrange a repayment plan with this one - only if they come threatening court. :(

    Hiya

As Locke correctly pointed out, the first two pages should be together, i.e. on one page (whether top/bottom or front/back) - can you confirm? This is what links things, however as above - i'd be sending this and see what they come back with: CCA Query:D

    Many many thanks as always

    Hiya

Its their standard response, just ignore that letter for now - you've already sent your final response so just sit and wait and see what happens next :o

    Good Evening NID ,

Can l call again on your vast knowledge and words of wisdom sent a cca to moorcroft regarding a credi card debt received the following reply

We refer to your recent letter requesting data as per Section 77-79 Consumer Credit Act 1974.

We duly confirm that we have requested the relevant documentation from our client and once received we will duly forward the same to you. Meanwhile, we duly confirm that all collection activity on the account has been put on hold and we will not seek to enforce payment of this debt until such time as the documentation has been supplied or we have advised you to the contrary.

In the meantime, however, we believe that it may be of assistance to all parties if we also take this opportunity to ensure that any potential areas of dispute are addressed prior to any possible court action or further investigation . To this end can you provide an indication of the information you will be relying upon, when giving evidence in court or information to the relevant statutory authorities in relation to the alleged subject matter of this account.

Please could you provide this information by return as this will ensure that all possible areas of dispute are identified as quickly as possible thereby minimizing potential costs and delays.

Do l assume that this is a fishing exercise to see if l will admit the debt, etc. and should l just wait for the CCA to appear?

    Many thanks

Ive had that one too flo about 6 weeks ago. Didnt respond and heard nothoing since.

I think most of us feel the same to a certain extent, but as you mentioned depression then it is not necessarily your fault. With depression can come bouts of both mania and manic. From being totally down or on a high. I know, I'm there and it's been alot of the cause of the ostrich syndrome for me. Having a particularly down time at the mo, to the point I struggle to keep awake all day, yet another affect of depression. But I'm starting to make headway - well I think I am and that means alot to me.

As I readily tell people no one would judge it you had a broken leg, cancer or any other illness. They should not judge when it's mental health issues, weight issues or any other kind of issue. We are what we are.

    Good luck to you.
    Thanks Rainbow:T
I'm much better now than I was 12 months ago. Its just a test of nerves to ignore the letter threats and phonecalls but after a time you just have to shut it out and get on with life. It just hits you sometimes but with the help of NID I feel like I have some control and can see a glimmer of light. I've stopped thinking about where i might be in 12 months time and just live each day at a time:j
