    Hi Niddy, very quiet on the creditors front only collect direct's handful of phone calls/letters lately. ToD-V letter stuck in royal mail deliivery system:mad:

    this is for anyone that have sent the CCA querys plus final letter etc, how long did this go on before (assuming they send a letter to say its been wiped) they gave in? as anyone been taken to court of this ? i mean on the unenforceable ones,and for the ones that havent heard anything for months on end do u still get your credit card statements through the door with the amount still building up, just curious

    also i found this i wont post the link incase of rule breaks on this forum

    "The test cases established some important precedents - firstly that lenders can continue to report the overdue statuses of accounts to credit reference agencies when an account is in dispute - and also that lenders are only obliged to produce a 'true copy' of the Consumer Credit Agreement, rather than the original." i,ve highlighted the relavant part, is this true? if so is there any point in sending a CCA query? when u recieve urs, hoping NID will answer at some point :) thanks in advance

    i think thats just for debts up to 15k, unless i,m wrong

    Evening everyone :)

    I sent a CCA request to Cap One
    No reply so reminder sent (30 days ago tomorrow)
    Debt sold to Capquest so appropriate letter sent
    Letter rec from Capquest stating they were putting my case on hold until 12/5/2010 while they investigated it with Cap One
    Letter rec today from Cap One stating they were looking at their records and would endeavour to reply within 28 days

    My questions are
    1) Are Cap One just stalling ?
    2) Should I send the CCA Dispute letter ? and if so who to ?
    3) Anyone else having a similar experience with Cap One ?

    Yes mate - ignore them!

    Its stalemate - you say it is unenforceable, they say it is not. So that's that.

    Case closed. If/When they write to you then let me know. Otherwise, forget it and move on mate :p:p

    I sent the sold whilst under dispute letter to Trident (who natwest have passed the debt to) they have just replied with the same responce i got from Natwest......

    Also I have received a rather shocking letter from mbna ( who have sent a letter saying they can not find the agreement) saying:investigations indicate i am a homeowner and they are considering seeking a county court judgement charging order on my house:eek:

    Have u sent the cca request? Have they replied? Give me details of events to date (mbna). They CANNOT obtain judgement without an original cca!

    Am on iPhone so just a quick reply to calm u down. Don't worry ok? You'll be fine, I'll be back tomorrow.
