    Hi everyone,

FatBallz has been calling us names again, such as freeloading scum.

Enough is enough - can we all head over to his post, and report the post which will in turn get the guy PPR'd for the constant abuse. Nobody here is a free-loder and certainly not scum. We do not need or deserve such insults.

The more of us that report him, means he should get banned - See his post here #7 - then click this: report.gif

    See my reply here #25

    Thanks everyone

    Hiya

Ok, lets see what they try and do then! When/if they return anything we'll worry about it then. Just do me a favour, can you try and give me a brief sypnosis of events to date as it will help me determine whether to respond or not.

Basically just give me a small bullet point list of what has happened - i.e. have I said it is unenforceable etc - what have you sent them etc etc

I will then possibly do a letter for you to send back threatening them with legal action of your own - as you do :D:D

    Hi Nid,

Received a letter back from Marbles today, after sending a letter on 5/ May, re post 2400.
Just says " Please be assured that we will contact you as soon as we can to discuss your concerns on this matter.. Please find enclosed our Complaints leaflet which explains how we will deal with your complaint "

    Nothing more.!!

    Thanks Niddy

    Hiya

Received a letter today from Robinson Way saying just because they can't find proof that I owe them any money the fact that I have been making payments proves to them that I acknowledge the debt and I have to continue paying them.

    :rotfl: :rotfl: :rotfl:

I'd love to see the law that confirms this bollox! LOL - ignore it, utter nonsense! Idiots
Even though there is no record of the debt anymore on my credit file as it defaulted years ago.

Yep - just ignore it - not even worth replying to.
Very very tempted to just completely ignore them, I've already written to them prior to this letter saying I wouldn't be having any further correspondence with them until they can prove I owe the debt with an agreement. Will have to wait and see what happens now.

You got it, simply ignore them - that's it. It is finished now. :T

    Hi NID.

From reading around it seems Barclaycard answer every CCA request by sending the terms & conditions and leaving it at that, whether the account is enforceable or not.

So what I want to know is when do they show their hand? They don't seem to acknowledge the account is even in dispute as from their point of view they've issued all they have to, is it a case of wait until they start court proceedings which will confirm they have an enforceable agreement?

Barclays did not keep agreements mate that is why they cannot provide them. They will not take court action and if they attempted it we'd be throwing a CPR31.14/31.16 request back at them to demand disclosure prior to any proceedings.

They are the worst, closely followed by MBNA. :D

    Hiya NID,

Had quick replies back from Egg & Citi with copies of CCA's in fact three copies have arrived, 1 from egg, and what looks like two from Citi, one with their name and one in the name of Peoples Bank of conneticut, I did used to have a peoples card years back but did not realise it was taken over by Citi ? I thought RBS took over their card business, but I have not sent a cca request yet in reference to my RBS card account ?

Do you need to see the agreements nid ? (lots of pages !) or what do you suggest as my next move please mate?

    Hiya

Email me - i've PM'd you my email address - send me the agreements, each account in a new email though and also use your mse username as the subject line.

I'll check them and confirm if they are enforceable or not. Then report back here with outcome. :):(
