    Hi NID, hope you're well

    Had my final response from lloyds. won't type it as I am sure you will have seen them before, just mention a few points;
    #They say I have used the card and paid it back over the years so this shows enforceability
    #I do not need an original copy of cca (only had a recon got the card around 1997)
    #Even in circumstances where an agreement may be unenforceable(they say here that mine definitely is enforceable) repayments have to be kept up to stop a debt collection agency contacting me

    A bit stumped with all that really appreciate your time on this.

    hi nid the 21 days have past and still no word back from c l finance and ulster bank and equifax about the duplicate default. i ordered a my report online there now and all the information is still there??? where do i go from here?? all letters where recorded delivery and signed for. as for cabolt i cant get the scanner in work to work so i posted the cca query letter to them just waiting on response now.

    Me again:o

    Gone to mums and she has had the same letter from M&S that I had this AM.
    Her agreement was for the store card see post http://forums.moneysavingexpert.com/showpost.php?p=32225629&postcount=2186

    She had not completed the form herself and had the store card some time before the agreement date, (years before). I remember her using the card when I was pregnant which is a year before the date on the app. The app/agreement has her signature and a shopping mall stamp on it as if she filled it in in store. Other info on the app is not correct like my dads DOB is wrong and his name spelled incorrectly.
    The other thing about it is.. do you remember my saying that when she sent the first CCA request M & S sent someone elses agreement complete with DOB, address, bank details, etc etc. Well the agreement my mum was sent (with her details on it) was completed by the same hand, has the same date and the shopping mall stamp on it. I know this could be coincidence but.............:(:(:(
    You havnt seen this agreement as I was pretty sure following the thread and other posts about what they sent. This store card was varied to a visa over the years but the app/agreement is for a store card.
    My mum is CERTAIN she applied for the card some years before over the phone or at another store, although she would have used it in the shopping mall.
    What do you think?:o

    You hang up on them if they call, or ignore them if they write! s.78 supersedes anything they want to do, collection wise. :D

    Continue to wait - nothing more to do until they respond..... you could if you wanted to waste your own time and money send a reminder to them - but why bother? Just sit back and forget about them until they come back to you! ;);)

    there is a template for this on page 1 - CCA Dispute - Forged Document Supplied

    All you need to do is list the things you just told me about, where outlined within the template. Then send it off - obviously you do not use words like "think"...

    Simply be blunt and to the point, below are the main ones you will add to the template:

    * My husbands date of birth is incorrect;
    * This is a second copy of application, the first was for someone else but miraculously this one is filled in using the same handwriting;
    * Going on above point how is this possible when this alleged agreement was taken out some 10 years prior to the last forgery you sent me?
    * The start date of the agreement is incorrect
    * My husbands name is spelled incorrectly
