    Good morning NID

    hope you are well today - going to help my friend today with one of your letters trying to get info to remove the default from her credit file - my friend has arrived now and she has had a letter from cabot advising they are trying to retreive the file from the original lender and all collection activities are stopped - however this was sent to her dec 2009 and now we wish to resolve it and request removal of the default.

    secondly i must now attempt and start with one of my halifax credit cards that ive yet to request a cca and now getting letters from moorcroft (cant get through to us as we have the truecall machine)
    Have not done anything with this one as other far pressing creditors having had todeal with but,,,,i want to start with this one and get to a point of addressing the issues in the right way with your letters and your help of course

    so latest is their records show not made any prev payments and now been passed to the Home Collections Division for action,
    this may involve local rep calling at the house to assist me to seek how im going to pay - if i want to agree payment plan to call them by next week
    if no satisfactory agreement made with local rep leave them no option to recommend to their client ((guessing here the halifax)) to instruct solicitors to commence legal proceedings without further notice.

    So i think i need to send the cca request to Halifax in Edinburgh registered address or
    to Moorcroft at their registered office address and not their P O Box - or does it not matter?
    Also what about the house visitor can i send or add details of the doorstop visit being denied by me?

    then i can start the ball rolling on this, havent paid in a while and guess i must have had a default but looking for paperwork and also awaiting credit files to check.

    you gave me some advise a couple of weeks ago regarding my freemans accoun( dont know if you remember) i have sent off the step 4 letter just awaitng a response from Moorcroft. Freemans also sent a statement with a zero balance. which is quite funny!!

    Any way I wanted to know can you request CCA from mobile companies i fist got my contract way back in 1997. Is it worth requesting a copy

    Newbie question - On the CCA request template - "Sign Digitally" , are you suggesting copying in a jpg of actual signature - or for those with tablet pc to Ink the signature digitally - or is it just a case of Joe Bloggs in type face?

    These were both sent last Friday – nothing back yet……….



    Have had another letter from DCA in Surrey - I haven’t acknowledged their first one yet. Do I continue to ignore them, or write summat while I wait for Cap 1 to answer?

    I had it ready to post when I saw that Cap One had put cheque for £1 for CCA through my account. Was expecting a response therefore, so decided to wait until I got one, then send it off if still applicable.
    Have heard from them, FPC, as well – letter 3. Heavy stuff.






    You really have nothing to worry about, you've come to the right place for help to get this sorted once and for all - just do not deviate, trust me and do what I ask and before long we'll have a letter confirming the debts are unenforceable - that's what you need. Just follow the process I outline for you mate.

    For the record, none of the lenders mentioned can take you to court and obtain any judgement, as things stand.

    I have decided to hang fire until you have checked over the CCA they have sent me.
    The scanner I have borrowed is on its way out and I can’t get the images clear. The only other way I can think of doing it is to scan them and send via email, but I don’t know if you allow that.

    They say it is a photocopy of the original, (see section of letter they sent me), but looks rather cut and paste in places. I have found a few identical ones posted on CAG – (all “signed” by the same person on Cap One over several years)? - - all differ slightly, like boxes in top right hand corner slightly off placement, which makes me suspect cut and paste. But all that may be irrelevant.

    I did not send payment for Feb, due in this week.
    Let me know what you think - will not do anything without your say so

    ages.... ago i sent the CCA Dispute - Forged Document letter that you typed up for me, good old welscum finance have finally got back to me saying

    "they are taking my complaint very seriously and will be invest
    igating, but in the mean time could i send them a copy of my credit report"

    what are they up too? is that a normal request?

    also i still have the dca threatening to take me to court, !!!!!!!

    Just a quick question. My Egg account has been sold to Cabot. I have CCA'd them a few weeks ago & they have now sent me a letter saying that they don't have it but have sent requests to Egg for it. Cabot haven't yet received it because there is a delay retrieving it from the archives (they say). What is a fair time length to give them to do this?

    hi again, i got a letter back from NDR but instead i got a reply from them as "shop direct"

    one part that stands out is this..."unfortunatly we are unable to locate a copy of an executed agrrements for your additions direct account, but for your information we enclose a copy of the current agreement which applied to this type of account. this version includes all contractual variations which have taken place.

    according to out records, the account was opened on 08/02/2007. you agreed to make payments every 28 days. in accordance with the terms of the catalog, statments are also issued every 28 days

    the outstanding balance is currently 1658.06. our records show that 172.80 in payments have been made in the last 12 months.

    id like to take this opportunity to remind you that payments must be made every 28 days in order to avoid a default charge and notice of default being sent to our credit reference agencies. we requlary share information regarding the performance of your account with our credit reference agencies, which is retained on your credit file for 6 years"

    so am i right in thinking there trying to flog me of here? do i send the next letter now? which one is it :) lol thanks guys

    You send the CCA Request to whatever address is shown on their letter and you send it to whoever last contacted you, so if it was a DCA that sent the letter above, you send the CCA Request and Threat of Doorstep-Visit letter to them - NOT the OC.
