Hi guys
Had a letter today from Mint regarding my CCA request. This is the bones of it:
Really need your help on this one as I haven't got a clue. We have an outstanding balance on a credit card of £4600. Once we receive the default charges back this will bring this down to £400. The card was Mint and was being dealt with by Triton. We had been paying £100 per month. It was my hope to some how manage a full and final with this and get rid of it but I'm guessing now that won't be possible.
We are obliged to provide you with a "true" copy of the credit agreement and a statement of financial information relating the account, namely the state of teh account, amout currently due, with amounts and due dates of futre payments that still require to be made. In terms of CCA copy document regulations the "true copy" requirement can be satisfied by providing a copy agreement at the date the card agreement laws made and providing that plus a copy of the current terms of the card agreement.
What they have enclosed is a photocopy of the original card application form which dates back to October 96. It has been signed and states this is a credit agreement regulated by the 1974 CCA.
So what is my next step with this, I guess what they have provided is sufficient in their case and therefore it is legally enforceable? Is there any point in trying to offer a !!!!!!?
Any advice greatly appreciated.

Hi
The fact that it is signed and that it states it is a credit agreement is irrelevant. nealry every Cap1 "CCA" posted on here meets those requirements but I have only seen one that was legally compliant.
Does it have the prescribed terms?
Can you scan it and post it up? remove account details, personal details and bar codes before posting, please. If you've have not made a mistake, you've made nothing0 -
As above, you need to check it for the required terms - http://forums.moneysavingexpert.com/showthread.html?p=26867833#post26867833
If your unsure, as above, blank out the personal details and post it up, just ensure the text is readable when opened in a web browser, people often host up very small images that are unreadable.
Scan in any relevant pages they have sent, no need for the letter, but the actual 'true copy' they have sent even, should only be a couple of pages but i have seen some that are 8 pages long.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.
There are two ways of constructing a software design: One way is to make it so simple that there are obviously no deficiencies, and the other way is to make it so complicated that there are no obvious deficiencies0 -
Thank you both for your help on this. I had to wait until I was back at work today to access a scanner. I now have this saved as a PDF. Can anyone tell me how to get it on here? I tried C+Ping but that aint working0

Save it as a JPEG image (not PDF file), and host it on a photobucket.com account (this way you can take the image down if needed)
Then put the direct url link to the image here. Ensure the text is readable.Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

I have put the copy of the original application above with the CCA bit at the bottom. I know you can't read it from this and certainly from the copy they sent me I can't read it either. The only bits I can read are the application bits and where I filled in details.0

This is the T&Cs that came with it:0

I appreciate that the above are both totally useless as scans. The system I am using will not allow me to convert to a Jpeg. Is there anything else I can do? If I walked into the likes of CAB would they be able to advise on whether it is valid as a CCA?0

A CCA request has to be legible, if you are saying you can read it well either. It is unenforceable. http://forums.moneysavingexpert.com/showpost.html?p=26870805&postcount=18Although no trees were harmed during the creation of this post, a large number of electrons were greatly inconvenienced.

They have sent an application form which does not have the prescribed terms intact and it is also illegible.
This is unenforceable, without question of a doubt. Send back the letter template as directed by darkconvict and await a better legible lawful (compliant) version being sent.2010 - year of the troll
