    The postman has been with a letter from Halifax!

    Just to say they've requested a copy of my signed application from the relevant department and this will be sent separately, for now make do with a copy of the current terms and conditions and those when you opened the account.

    Nothing of interest but I thought I'd give this thread some action!:D

    I've just had a interesting little letter for MBNA on my wifes account stating that they are having to request the CCA for the original cc company ( it's taken them 4 months to get to this point).

    The bit of interest is they are implying because of McGuffick v RBS, that she should keep on paying, my understanding was that all the case said was a lender could report the non payment is that correct?

    Also what's the siuation on interest increases and chargers if they can't supply an agreement?

    Ive always told you this mate! McGuffick means they can report data to the CRA's - ive always told you that a default will be forthcoming but still, you dont pay!

    Did you miss this....? Basically ignore then and cease payments, assuming you already have like? :o:o

    Even though Littlewoods wrote to me confirming they won't be persuing me for the debt, i yesterday received a letter issuing me with a default notice. Do i ignore this?

    I'd just leave it for now, then later on you can try and fight for removal.... just let things settle for the time being.

    Remember with unenforceability the debt is always there, just that they cannot pursue you for it.... they can and do report to the credit agencies and a default is all they can do - they cannot ccj you can they? lol

    Hiya NID. CCA'd Lowell and 1st Credit 2 weeks ago 2moro regarding Cap 1 and HFC respectively. Had 3 letters from Lowell saying...1 - we're sending it to the right department (what the desk across from you? haha)...2 - we've sent a request to Cap 1.....3 - I can confirm Cap 1 are searching their archives....once found you have to pay blah blah. Do i just wait even though it's more than 12 days?

    Also...had no response from 1st Credit whatsoever......??
