Hi NID,
I don't know if you remember me but I have been waiting to change bank accounts from natwest to another bank. I have 2 loans with natwest.
I sent cca requests in mid -nov on both. One of them got a reply saying they have 'misfiled ' my loan agreement and if I do not pay they'll report to cra's. That's fine by me.
On the other I did not receive a reply at all and sent cca reminder letter at end on december. Still heard nothing at all.
I have been paying the loans, as i had problems switching banks ( thanks, alliance and leicester!) and didn't want it to be taken from my wages. Effectively, things were put on hold re the enforceability process. Now going to stop paying in April :0
Anyway, i've now switched banksAs such a long time as passed , should i still send the CCA dispute letter or skip straight to debtors's final response?
Sorry if i'm being dumb but just want to check it out .0 -

Of course I remember - the 1st loan is brilliant news - no agreement means no repayment means unenforceable.... Excellent :T
Regards to the 2nd loan, send this: Debtors Final Response - No CCA Received
See what transpires but you must cease repayments on both as right now they are both unenforceable - as you know, you will get defaulted but that is ALL they can do... hehe

Style I wasn't sure about because it said card application on it, and I thought it had to be an actual contract not application.
But this is why I checked with you.
At least the other 3 are unenforceable.........or at least 2 are unenforceable and the other have said they're giving up until they can find the CCA.

Sorry maybe I missed that (the text at the top was hard to read) - can you confirm does it say on the form at the top in large bold writing anything along the lines of:
"Credit Agreement Regulated by the Consumer Credit Act 1974"
If so then it will be enforceable, if not then scrap my last advice and send CCA Query
