glad you had a nice weekend just a quick question it is nearly 12 + 2 days since i sent mt cca request off to halifax and i still have not heard anything which should be good right?
i checked the royal mail tracking and my letter to them still saying its in the network
should i start again as i think they have lost it

You simply leave them to respond, obviously it is unenforceable right now and it stays that way until they respond....

My Capquest & Apex are in hand with your 2 letters. Not heard back from either which is good news.
I just need reassurance that I've done the right things so far regarding my American Express or a Niddy rant if I haven't!! :eek:
This is where I may have got a bit confused - my OC was American Express, but I get responses from RMA resolve, the footer says NCO Europe Ltd trading as RMA with an address Old Docks House, Watery Lane, Preston, PR2 1AU.
Now I sent my original CCA request to NCO at the above address and they sent me an unenforceable American Express agreement (checked by your good self).
Since then, I have continued sending the relevant letters to the above NCO / address including a final response on 5/03/10.
I have now recvd a Notice of Removal from Resolve letter???
Basically it says, due to my account now failing to meet the required criteria, they are forced to review their position. With regret, give me notice the account is to be closed out of our financial difficulties programme and referred back to their client for further action.
Due to a lack of co-operation we have recvd, we have little choice other than to strongly recommend they take immediate legal action to recover their loss as their attempts to broker a voluntary repayment plan have failed.
The only way to prevent this at such a late stage is to call them within 48 hours.
This just got me thinking, have I been sending the letters to the wrong people and not actually been sending them to the OC? Given RMA sent my perceived CCA, I thought I was still doing the right thing?
Edit - There was a clause in my original request for the CCA that they have a duty to pass this onto the OC if it's not them, so hope this may cover me.

Received a letter from Littlewoods (Shop Direct) on Saturday saying they will not be persuing me for the outstanding balance :j
They said no further charges and interest will be added to the account. Do i just leave it now or ask them to credit the account with the balance outstanding?0 -

Hope you don't mind me asking, but was your account still in house or with a DCA? Had they already defaulted you - guessing not if they were still adding charges and interest? I'm doing a CCA request for my old Kays/Shop Direct account, hence being nosey0 -

Morning mate - they can unfortunately ring at any "reasonable" hour - in order to speak to you, but just block the number or store it so when it rings again, you know who it is and can ignore it.

Nope - you have proof of postage, hold fire a wee bit longer. Bear in mind you only see that it has been delivered once they update but the main thing is you have proof you sent it.
Leave it until about 4 weeks then send the reminder letter.

Morning,
Just a quick question - I sent a CCA request off last week (Monday) and they've come back demanding my signature etc. I've (today) sent off your template letter telling them i'm not going to sign. Do I now allow them another 14 days to provide me with the CCA or stick with the original timeline?

Whisp - don't you worry about them! So far i've had almost every SDG one made unenforceable - cos they usually are lol....
