Hi, Ive been on DLA for a few months now and i got sent an Incapacity for work form through the post 6 weeks ago. Ive filled it in and sent it back, the application didnt arrive and theyre stopping my Income support as a result, ive been on Income Support for over a year now.
After talking with some friends who are also on DLA and my Dad aswell, ive been told by all 3 that because im on DLA i dont have to fill in any forms apart from a change in circumstances form for 3 years from when i started recieving DLA. Can anyone confirm or deny this please??
many thanks
Paul

            Hi Paul
What rate of DLA do you get. You are only exempt from completing the Incapacity form if you are in receipt of high rate care.
Contact your local CAB or welfare rights get them to phone JCP advise you have sent in the IB50.

Paul, I don't know if what I'm telling you is applicable (I don't work for the DWP) I'm only going by my own experience.
So, basically, my advice could be as useful/helpless as your friends/family.
It sounds as though you've had an IB50 form sent to you. If this is the case, not only do they send the form a few months in advance, but they also send a reminder if you haven't returned it within a certain time. I know this because I received both.
Sounds as though it's the IB50 they haven't received, this has nothing to do with your DLA.
You need to chase up the IB50, resubmit it if needs be. This is what's stopping your IB/IS payment. Without proof of your status, they're hardly going to pay for you, are they?
Sorry to sound blunt, I don't mean to, but this has nothing to do with your DLA but all [I'd imagine] to do with your IB50 that your friends/family know nothing about.

ETA: I receive IB, IS and DLA (Low mobility & middle care) but I receive these IB50s every year or so...0

Im on mid rate myself, but the people who where telling me this are all on High, they probably thought it was the same for mid and low rate care componant recievers.
now to sort out the fact they lost my original form i sent them 3 weeks ago. Only found this out yesterday as i recieved a letter saying theyre stopping my Income Support on Monday 1st March because they didnt recieve my form. Grrrrrrrr!!!!
 thanks for clarifying0

Those on HRC (amongst others) are exempt from the PCA.
Did you send your form by recorded/ special delivery, or confirm receipt by other means?Gone ... or have I?0

I think that's where the confusion has arisen.
I'd be shocked if it wasn't because of your [allegedly] missing IB50 form. Chase that up in the morning, you owe it to yourself to sort it out - sadly being a person on benefits, you have to sort it out yourself, we don't have a union etc. 0 0

nope because i was under the impression it wouldnt get lost.
Unfortunately, unless you can prove that you did send the form, there is little point in appealing against the termination of your claim. Therefore if you are still incapable of work you will need to make a new claim for ESA.
You stated that they are stopping your IS - have they not already stopped it?Gone ... or have I?0

I had my latest IB50 form to send back a few months ago. Not only was it not sent recorded, it was picked up by the postman [who wandered into the post office ] who assured me it would get there ok - I was in the que ready to pay for recorded delivery. I had no proof of postage.
I handed my post over, with no proof of it, to a stranger and I trusted him to be who he said he was. *oops*
I must admit, I did think that postie may just chuck those letters in the Clyde etc But, despite my fears,he must've delivered it along with the rest of his mail. But, despite my fears,he must've delivered it along with the rest of his mail.
No point beating the Op up, for things they didn't know about, anyway. I can't remember the DWP advising to you recorded etc mail, as far as I'm aware they usually send a pre paid envelope. 0 0
