Broken LP, help needed please

    Is the seller UK based or is he in Canada?

    Basically your only recourse is through the seller. Royal Mail won't be interested as their contract is with the seller. Credit Card won't be interested as there isn't a direct link between you and the seller (you used PayPal as a middle man).

    If the seller is UK based you can do down the small claims court route if they don't co-operate, if they are Canadian, you can always threaten to leave negative feedback (if they are a regular seller this may make them more compliant).

    if paypal say no it is still worth going through your credit card, i bought something under £100 through paypal , got conned (so did alot of others) paypal said they wouldnt refund me as they couldnt get the money off the seller, went to my credit card and they refunded me fine,
    that being said, it was about 7-8 years ago now.

    I very much doubt from a reputable record dealer that they would send a record out broken in two.

    Did they offer you insurance when you paid for the postage for the item?

    Get in touch with the seller and tell them that it has been delivered damaged and they need to raise a claim against the Canadian post office for damage in transit.

    I would think they would give you a full refund as they should receive the money back from the post office and compensation for their loss as well.

    They would have gotten a proof of posting so it is all down to the insurance that was paid for when the record was sent.

    My parents run a business like this for 20 years and we actually had at least one instance where the postman could not get the package (an LP) thorugh the post box so he bent it in half.

    We insured anything that was over £39 with the post office and we refunded the person buying the record in full as well as receiving the amount that we paid for the record back so we were not out of pocket.

    Get in touch with the seller. I am sure they will be ammenable.

    Damaged Mail or Missing Contents

    When a Customer wishes to make an enquiry about damaged mail or missing contents, the Customer should:
    • keep all wrappings, packaging materials, invoices or mailing receipts if available, and the damaged item, and
    • call Canada Post Customer Service at 1.800.267.1177 and provide details of the damage or loss, including all postal service identification numbers (such as Registered Mail or Xpresspost number)
    NOTE:
    For an item delivered outside of Canada, advise the addressee that their Postal Administration must complete a CN24 Report (detailing the damage).

    You will probaly have to supply the seller with the mentuins CN24 which I am guessing will need to be provided by a post office so keep the record and packaging so they can see the state and supply that with probably a claim number to the Canadian post office.

    Speak to the supplier though as they will need to make the original claim and then advise you on what they need from yourself.

    Thank you all for helping me with my enquiry. I have now managed to contact the seller (they are a - seemingly - reputable online music store) and the person I spoke with said that they will refund me in full. Having said that, he was meant to have emailed me yesterday but I haven't got anything yesterday or today.

    But at least now I have a few ideas and a lot of information, thank you again everybody for taking the time to help.
    Finally I'm an OAP and can travel free (in London at least!).

    For the second time tonight, I would just like to point out the obvious:
    If you have a problem with a product - e.g. it's broken, faulty - contact the retailer or manufacturer as a first course of action. A good company will help you. That seems to have happened here.

    Thank you all, for your help and information.

    I am delighted to inform you that the sellers refunded me in full via Paypal. I am very impressed with their courtesy and speed of action. I shall go to the place where I had ordered the item and put a very positive comment on their service.
    Finally I'm an OAP and can travel free (in London at least!).
