Barclaycard Disgrace!

Hi,

Can someone please tell me if it's legal for them to take money out of your Barclays account without permission for an overdue Barclaycard payment ONE DAY late?

I had a bereavement in my family last week and believe it or not my priority was not to pay my 2 cards payments. It was due on the 19th Feb, and on the 20th Feb I got several phone calls from them, and told them about the bereavement and they continued to say 'this will just take a minute'. I then received a further call, and 2 more on the 20th, the following day, after they said they wouldn't call me again. I told them I'd pay it on Monday, but, I didn't know they'd already taken the money out of my account without my knowledge and not telling me.

Now I may understand if they took money without asking if it was a month late, or 2 months late, but how dare they do this after one day late?

My business and personal account is with Barclays and I am considering closing both of them.

Which lunatic asylum actually trains these people anyway? They are a total disgrace, 12 billion profit not enough for them last year that they were so desperate to rob me of £200?

    unfortunatly they can do that and the continued calls were probably to tell you that but due to ur circumstances you didnt give them chance to tell you that

    How much did they take? More than the minimum? The whole balance?

  • It's called the "right to set-off", and is in the T&C's. Setting up a Direct Debit for the minimum (or whole card balance) is a good thing to do, as if you forget to pay, it doesn't matter.

    Rob you? The money was overdue...

    It seems most odd that would make telephone calls if you were just "ONE DAY" late. Also seems strange they'd be so quick to transfer the money, but I suppose if you'd appeared obstructive they might have felt they needed to. Yes it's "legal".

    There must be something else going on... have you been late before? Is there any other history you've not told us about?
  • Yes, I did give them the chance to tell me FOUR times, but none did, The third apologised profusely that I'd been called repeatedly due to my circumstances and said it's OK for me to pay this week, and then 25 minutes later another idiot called ignoring all that.

    They took the minimum payment amounts.

    And regarding past history, one year ago I missed a payment and they took it 4 or 8 weeks later, I can't remember which. However there is no excuse for taking from me one day over, after I was told I could pay this week, which I did, only to log on to my bank to see it had already been taken by them.

    And yes, Rob me. Payment, Late Payment charge, extortionate interest, and imbociles in call centres who can barely speak English let alone understand anything other than how to harass customers.

    Presumably if I close my business and personal accounts with Barclays, they can't do this in future?

    Oh, and one of the idiots said I was a good creditor, that's why they rang!! Total rubbish
  • They would not have known about your bereavement - you were late in paying and yes they have a right of set off.
    Sorry if this is not what you wanted to hear.

    Legal, and you signed up for it when you applied for the card.
    I had a bereavement in my family last week and believe it or not my priority was not to pay my 2 cards payments.
    As others have suggested, a direct debit for all or part of the balance could help you in future.
    Now I may understand if they took money without asking if it was a month late, or 2 months late, but how dare they do this after one day late?
    Your credit file looks healthier as a result of their actions. They have done you a favour.

    It's your call. Other banks have exactly the same option though. If it is something that offends you perhaps moving your credit card away from Barclays (and their right of set off) would be better.

    Bereavement is a difficult time and people say and do things they don't mean.

    You have not been robbed. You had failed to meet your commitments on time and they took what was due under the terms of the agreement that you made with them.
    And regarding past history, one year ago I missed a payment and they took it 4 or 8 weeks later, I can't remember which.     You are correct. As you owe money to them, they are one of your creditors.

    Ultimately, you're over-reacting to something that you forgot to do because of your bereavement. That isn't the fault of the bank.

    You mention "extortionate interest". By taking the payment quickly they will charge you less in interest and the impact on your credit file will be potentially less damaging.

    You would have paid the bill from your Barclays account if you hadn't had the bereavment - so in a way they've done you a favour, you don't have to worry about paying the bill anymore!
