So handing tens of thousands of pounds to a retailler that has a track record of shafting you is brilliant too? The delay is the dealers problem, not the customers as the contract of sale is with the dealer. Or does the SOGA not apply to new car dealers?

Were exactly is there a SOGA breach here.
Dealers terms always allow for manufacture delays and quote estimated delivery dates etc.

The OP hasnt been shafted. He has simply been inconvenienced due to circumstances outwith the dealerships control which is fully covered and allowed for in their terms and conditions and the trade.

The SOGA has not been breached so is irrelevent.

The OP may have the right to cancel if he wishes but he may well be worse off.

The dealer can only give the best estimate that they receive from the factory. If the factory decides to slow production for quality or technical issues then that is outside the control of the dealer.

The dealer ISNT shafting the customer here, they are following a clearly defined procedure outlined, and agreed by the customers signature BEFORE the order was placed.

One thing i would say is ask to see the sales manager, explain the situation and ask can a compromise be reached.

hence the 2.5% term per month is valid.

Except second hand prices are going up. You need to do some research on this one OP. Try and get hold of Glass's Guide for the relevant months.

    Personally I would be livid.
  • The OP has suffered a consequential loss due to not receiving the goods he purchased within the agreed timeframe. the buyers contract is with the dealer, not the manufacturer, so surely the legal responsibility falls on the dealer. If it was me I`d be fighting tooth and nail with the dealer to get the deal I signed up for and if it didn`t happen I`d walk. As it`s not me this is the last thing i`m going to say on this matter but you all seem to be acting as if losing a grand through someone elses fault is something you`d just shrug off as if it was no big thing. I`m glad your all so wealthy, I hope I can join your club some day.
Plus Hintza is very right, used car prices for many cars has went up steeply in the last few months.

The big difference between you and the guys on here is that they have lived life and are more accepting of things that go wrong and how to deal with them realistically rather than screaming and shouting and being hot headed.

Interesting point, used car values standing still or going up.
Comes back to my earlier point, is £333 a month depreciation fair?
I stuck my car on "webuyanycar.com" 2-3 months ago for interests sake and not long ago they emailed again with an offer something like £500-£700 more than before.
If the value of your car really has stayed still or improved you have a different conversation to be having with the dealer along with proof of your cars current market value.... ;)
  • So I haven't lived life? interesting I wonder what I've been up to all these decades. Was anything said about screaming and shouting and being hot headed? I think your the one who needs an attitude adjustment, making personal attacks on someone you dont know because their opinion on something differs to yours.

I'll give you a clue from someone who has lived life. "fighting tooth and nail" to get something is a figure of speech meaning to try every means at your disposal. It doesn't involve actual fighting. Usually.

And having waited 6 months on the car, what would walking away achieve - other than another 6 month wait elsewhere.

I'd try to negotiate with the dealer on the price of the trade in - as someone else has said, it should be too tricky to get a 3 month old glasses guide on ebay as evidence.

OR ask them to show you how they came upon that figure.

I certainly wouldnt walk away in a huff.
