Tiscali still charging me even though Be went live 6 weeks ago

I've just swapped my broadband away from Tiscali. The email they sent me said "Tiscali will not cancel your account until you have given your MAC code to another service provider and they have successfully migrated your service. ". I gave my MAC code to Be on 2 Jan, and the service went live on 13 Jan, so I haven't used Tiscali at all since this date. I'd call this a successful migration!

I recently received my Feb bill from Tiscali, and they're still charging me - so I contacted them and (after a delay of 6 days) they say "Upon viewing your account I can confirm that it is still active. Therefore, I escalated your account to our Provisioning Department and requested that they fully cancel your account. Please allow 10 working days for your account to be fully cancelled. I have also requested that once your account is fully cancelled, that it is escalated to our Billing Department to investigate if any overcharging has occurred."

How can they charge me for something I'm not receiving?!! No wonder I left...

But do you not have to give one month's notice to Tiscali?
Did you not cancel the DD after you received your final bill?

When I phoned up for the MAC code I specifically asked whether I had to give a month's notice, and was told that use of the MAC code worked instead of the notice. I was expecting the Feb bill to be my final bill, because I was waiting to receive a refund they had promised me on a mess they made with my phone bill, and a refund for part of the Jan broadband. Unfortunately I was paying by credit card not direct debit - so harder to cancel!

Impossible to cancel a recurring debit on a credit card, not a good idea to ever use them for that purpose. Only the payee can cancel it.
