have you checked out yout entitlements? www.entitledto.com you might get something your not getting at present.
Also speak to those you owe, explain the situation and see if they will wipe away some of the balance.
    Best Wishes.

  • Sorry to hear how rough things are at the moment. It appears that the dmp is not working for you as quite clearly you can't afford 90 a month and it will just make your situation worse financially. If all you can afford is 1 pound a month (token gesture - then so be it).
I would definitely write to the creditors and explain the situation and tell them you are paying what you can afford.
Unfortunately for you some people will come up with every lie in the book (ie husband/wife is ill) which makes companies suspicious towards everyone - even when in your case it is genuine :(
If they persist in hassling you/threaten you with court after you have explained your situation then you should probably raise a formal complaint with them and then approach the ombudsman and/or the newspapers - the big companies probably won't like being named and shamed if they are hassling you.
Why not have a chat with one of the other debt organisations and see what they suggest? although I suspect it will be bankruptcy or token payments - but they may be able to help with getting the creditors to back off a bit.
I just hope the companies can give you some breathing space at this very difficult time and you can make the most of the time you have with your husband.
    Big Hugs.

  • Not sure whether you are getting carers allowance etc? Also did he or you belong to a professional association? some professions will have hardship funds etc or be able to provide assistance in other ways - eg I think teachers/nurses/army people etc all have support organisations so maybe something like this would help you depending on what you both did?
Even just a chat to offload may help and to know you are claiming everything you can etc.
Also I'm not sure whether social services can help you at all - in terms of providing any practical aids or offer any respite care from time to time- o.k not necessarily financial but hopefully it will make things a little easier for you.
Also the internet is a mine of information - there may well be support groups for people affected by the condition your husband has - and they may be able to advise on benefits, etc.

  • Yep - write to the creditors offering £1 p/m and enclose a letter from your husband's doctor/consultant. Request interest stopped. Request all contact in writing.

If they won't play ball then consider just unplugging the phone. It's not the responsible DFW thing to say, but honestly, what do they expect you to do? Due to your husband's illness, and for no other reason, you have gone from two incomes to none.

The worst that can happen is they may eventually take you to court. The court will not order you to pay what you do not have, and a compassionate judge would laugh the case out of court. So stuff them, the unconscionable b*st*rds. You have more important things on your plate.

Another avenue, if your creditors keep chasing, is to complain in line with the company's complaints procedure. Eventually, your case will come to the attention of someone with a few brain cells, who will realise it is very bad business to hound someone in your position. Be reasonable - tell them you will be able to raise your payments again once your husband has died. I'm very sorry to put it so directly, but that is the language banks understand and that is what they will want to hear.

    All the best.

I agree partly with the last post, however, the op must make token payments, because it this goes to court, the judge will not laugh it out in my experience. A neighbour of mine had breast cancer and was heavily in debt at the time due to the illness (her husband was self employed and had to care for her, she was very ill from the chemo), the judge still ruled in favour of the mortgage company and the other creditors (despite a letter from her consultant) and the house was repro a little while later.

Whilst you are in a most difficult situation, you must not ignore or forget to make token payments. Do speak to the CCCS or even the CAB before you do anything.

Do let us know how you get on.

    Thinking of you.

Agreed - although I did make this clear (I think?)

OK but this was a secured debt and with a house at stake. The OP on this thread is in unsecured debt and has far less to lose. Plus - look at her SOA. What can the judge order her to pay? She doesn't have any money (currently) to service these debts. Plus at least a CCJ will crystallise the balance and prevent interest and charges.

I agree with you about keeping up token payments though.
