Help!! someone has opened credit card in my partners name!!

Please can someone help!!! we have just found out someone has opened a credit card in my boyfriend name ( 4 years ago)!! we have had debt agencies ringing, we have spoke to the card people and they have said we have to except the debt and then they will send prove!! we have never had the card or statment!!! my partner got a phone call on his moblie from the debt people saying he has to pay!! we dont know what else to do as they say we have to pay!!

We have said to get the police involved as he knows it is not him!! but 2 payments have been made using h card some how??? they said because of this he has to pay!!! we keep getting told all different things but dont know how we can prove this if they wont send any out unless he says it was him!! please help as we have found out this is now effecting his credit rating!!!

    Yeah they are annoying.

    OP to calm you down before someone comes along with more advice -
    1. You don't have to pay at all.
    2. Your partner doesn't have to agree the debt is his. Instead they have to prove that the debt is his.
    I'm not cynical I'm realistic :p

    If it is not his debt...then never ever admit it like they've ask you to do. They have to prove that the debt is yours. Never talk to them over the phone, always in writing. If they keep calling you have some template letters you can send on "Nationaldebtline" website. He needs to check his credit report with both Equifax & Experian to see what if anything has been recorded against his name, if nothing at all then it would be good news in some way.
  • they said the card was opened over four years ago!! this was the first time we had heard of this when he got a phone call!! they keep saying different things all the time about where the card was opened!! but both the propertys are family's so if any letters would have come we would have been passed these!1

    we were told bailifs went to one of the propertys ( which is his mum's house) but this was the first we had heard of this!! his mum would of been on the phone to tell him!! we got told they have phone recording as all the calls were made from his mum's property!! which when we asked to prove this they said they cant!! just feel like there is no way out of this black hole!!!!

    Be careful by writing to them can constitute an acknowledgement which would then restart the clock for statute barring if it is an old debt of his he has forgotten about, even if you write 'without prejudice' etc on the letter this still classes as an acknowledgement. If you call them and ask them to send you proof of his liability for debt then a phone call does not acknowledge the debt.

    I work for the cab and found this out yesterday whilst helping a client with the exact same problem.

  • Mr Chip-pin, used to be a successful Salesman in the Credit card industry, but in reality, he was an expert user of sub-prime plastic and not much else.

    After reaching the heady heights of such success at his present firm, he was put on gardening leave due to the company being taken over whilst they chewed the fat as to whether to offshore the whole business to a couple of chicken sheds in deepest Guano.

    Miraculously even in the recession, he stumbled upon an advert for a pimp...err sorry, Credit Card Account Salesman; which promised him more money than he had seen due to the huge apr's. The ad looked so short, ‘being only 1 whole sentence in length’ he thought that it was “punchy and to the point”.

    So he applied and sure enough was granted a telephone interview.

    Hot, flustered and sweating, he waited by the phone for his interview the next day at 10am sharp!

    10, 10:15, 10:30, 11:00 and 12 came and went but no phone call came. He of course, went to speak with his wife in the kitchen and questioned the validity of the position (after using a dictionary to see if that’s how he should spell validity) with her. She told him to call up the Card company involved, but he didn’t want to, for fear of peeing them off and the thought of navigating 14 different call centre menu options.

    Just as he started to sit in his circular, white cushioned wicker chair, he went to grab the phone. As his hand neared the phone, it suddenly rang, making him jump in fright from his half seated position, knocking the phone off the hook whilst he fell sideways into the new ‘indoor’ giant cactus plant that he’d bought really cheaply from some ‘special 20% off garden stuff weekend at some pointless DIY store’ .

    He shrieked with phone in hand as he announced something about pr**ks. He heard a voice on the other end of the phone. Suddenly realising that the other person must’ve heard his mutterings, he attempted to apologise. “Don’t worry” said the voice, you’re just the person for us.

    Can you start tomorrow?
  • we have asked them to send proof but they have said he has got to accept it before they will send any think out to us!! we have asked for the copy of signature and then we will send Id but they wont send any thing. The only thing they have sent is a letter saying they have looked into it and that it is him?!?!

    we are in contact with the' ombudsman service', to see if they can help.
